  1.1                          A bill for an act 
  1.2             relating to crime; requiring the court to impose 
  1.3             mandatory minimum fines on sale of tobacco to 
  1.4             children; amending Minnesota Statutes 1994, section 
  1.5             609.101, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 609.101, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3a.  [SALE OF TOBACCO TO CHILDREN OFFENSES; MINIMUM 
  1.10  FINES.] (a) Notwithstanding any other law, when a court 
  1.11  sentences a person convicted of a tobacco related crime under 
  1.12  section 609.685, it must impose a fine: 
  1.13     (1) of not less than $250 for a violation of section 
  1.14  609.685, subdivisions 1a and 2; and 
  1.15     (2) of not less than $150 for a violation of section 
  1.16  609.685, subdivision 3. 
  1.17     (b) The court shall collect the fines mandated by paragraph 
  1.18  (a), and forward: 
  1.19     (1) 50 percent of each fine collected to the school 
  1.20  district within which the offense occurred to be used for 
  1.21  nonsmoking health education purposes; 
  1.22     (2) 40 percent of each fine collected to the law 
  1.23  enforcement agency responsible for apprehending the person 
  1.24  convicted of violating section 609.685; and 
  1.25     (3) ten percent of each fine collected to the commissioner 
  2.1   of health to be distributed to the smoke free 2000 coalition. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective August 1, 1996, and applies to 
  2.4   crimes committed on or after that date.
