A bill for an act
relating to data practices; classifying certain data related to a study of
entertainment facilities in Minneapolis and St. Paul; amending Minnesota
Statutes 2012, section 13.55, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 13.55, is amended by adding a subdivision
to read:

new text begin Data classified as not public
pursuant to this section or any other provision of law shall be shared with the Department
of Administration in order to complete the study required by Laws 2013, chapter 143,
article 4, section 39. Financial and business data of each arena collected or received by the
department from arena management or tenants are nonpublic data, including:

new text begin (1) past costs and revenues;
new text end

new text begin (2) projected costs and revenues;
new text end

new text begin (3) balance sheets, financial statements, and income tax returns;
new text end

new text begin (4) five-year historical capital improvements;
new text end

new text begin (5) five-year projected capital improvements and anticipated costs;
new text end

new text begin (6) management, partner, and operating agreements;
new text end

new text begin (7) marketing plans, premium seating, and sponsorship data; and
new text end

new text begin (8) current and projected impact of each arena on each city's general fund.

new text begin Each arena manager or tenant shall determine the amount, type, and extent of financial and
business data classified as nonpublic pursuant to this subdivision that may be included
in the final study report. The final study report is public.
