A bill for an act
relating to human services; adding two group family child care license
classifications; amending Minnesota Statutes 2004, section 245A.14, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 245A.14, is amended by adding a
subdivision to read:

new text begin Additional group family child care licensure classifications. new text end

new text begin (a) In
addition to the group family child care licensure classification options in Minnesota Rules,
part 9502.0367, classifications defined under paragraphs (b) and (c) are also available to
qualified group family child care applicants.

new text begin (b) For the purposes of this section, "license classification C4" means that:

new text begin (1) the applicant meets all relevant requirements under Minnesota Rules, chapter
9502, for group family child care providers;
new text end

new text begin (2) the maximum licensed capacity for the program is 19 children, of which:
new text end

new text begin (i) no more than 14 of the children are infants, toddlers, and preschoolers;
new text end

new text begin (ii) no more than five children are under 2-1/2 years of age; and
new text end

new text begin (iii) no more than three children are infants;
new text end

new text begin (3) there is always at least one adult caregiver and a second caregiver present. The
second caregiver may be a helper rather than an adult only when there is no more than one
infant present; and
new text end

new text begin (4) the facility complies with the Minnesota State Fire Code, Group E Occupancy
classification.

new text begin (c) For purposes of this section, "license classification C5" means that:

new text begin (1) the applicant meets all relevant requirements under Minnesota Rules, chapter
9502, for group family child care providers;
new text end

new text begin (2) the maximum licensed capacity for the program is 25 children, of which:
new text end

new text begin (i) no more than 21 of the children are infants, toddlers, and preschoolers;
new text end

new text begin (ii) no more than five children are under 2-1/2 years of age; and
new text end

new text begin (iii) no more than three children are infants;
new text end

new text begin (3) there are always at least three adult caregivers present; and
new text end

new text begin (4) the facility complies with the Minnesota State Fire Code, Group E Occupancy
classification.

new text begin (d) License holders holding a C5 or C4 classification license may operate as
smaller classification licensees when the number of children present does not exceed the
cumulative or age capacities for the lower classification license.
