  1.1                          A bill for an act 
  1.2             relating to employment; requiring payment of the 
  1.3             prevailing wage on tax-subsidized power plant 
  1.4             construction projects; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 177.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [177.436] [TAX-SUBSIDIZED POWER PLANT 
  1.8   CONSTRUCTION; PREVAILING WAGE.] 
  1.9      Contracts for the construction or expansion of an electric 
  1.10  power generating plant that receives a state tax subsidy must 
  1.11  comply with section 177.43 requirements regarding payment of 
  1.12  prevailing wage rates, prevailing hours of labor, and payment 
  1.13  rates for work in excess of the prevailing hours of labor.  
  1.14     For the purpose of this section, a "state tax subsidy" is a 
  1.15  reduction or elimination of a tax obligation, including, without 
  1.16  limitation, sales and use tax, property tax, and income tax, 
  1.17  that is contained in a law that identifies either specifically 
  1.18  or in general terms a particular electric energy power plant. 
  1.19     This section applies regardless of whether state financing, 
  1.20  other than the tax subsidy, is used to construct or expand the 
  1.21  plant.
