A bill for an act
relating to the military; appropriating money for payments to certain current and
former Army National Guard members to satisfy federal obligations to those
members.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin MINNESOTA ARMY NATIONAL GUARD BACK PAY;
APPROPRIATION.

new text begin (a) Beginning March 1, 2010, the commissioner of management and budget shall
make up to $10,000,000 available from the balance of the special revenue fund for a loan
to the adjutant general for the purposes of paragraph (b). This amount shall be available
until August 1, 2011.

new text begin (b) The amount made available under paragraph (a) is appropriated to the adjutant
general for payments of compensation owed by the federal government to eligible current
and former members of Minnesota Army National Guard units. The adjutant general shall
determine whether an individual is eligible for payment under this section as follows:

new text begin (1) the individual must be entitled to payment from the federal government for
extended active duty in addition to regular active duty pay received during an extended
deployment ending in July 2007; and

new text begin (2) the individual may not receive any payment under this section for service that
has already been fully compensated by the federal government.

new text begin (c) Before making any payments under paragraph (b), the adjutant general shall
obtain written assurance from the federal government that any federal money received
by the adjutant general from the federal government for payments owed to individuals
described in paragraph (b) may be deposited in the state special revenue fund in a manner
determined by the commissioner of management and budget.

new text begin (d) Until August 1, 2011, any payment received from the federal government that
has already been provided to individuals under paragraph (b) must be deposited in the
special revenue fund. Payments subject to paragraph (b) received after August 1, 2011,
must be deposited in the general fund.

new text begin (e) The difference between the amount of payments made to individuals under
paragraph (b) and payments deposited in the special revenue fund under paragraph (d)
as of August 1, 2011, is appropriated in fiscal year 2012 from the general fund to the
commissioner of management and budget for transfer to the special revenue fund.

new text begin (f) Nothing in this section shall be construed to release the federal government from
any obligation to provide payment to the adjutant general for the compensation owed to
individuals eligible for payment under this section.
