  1.1                          A bill for an act
  1.2             relating to highways; requiring commissioner of 
  1.3             transportation to transfer ownership of certain 
  1.4             parking facilities to the city of Minneapolis; 
  1.5             amending Minnesota Statutes 2002, section 161.1231, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 161.1231, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 11.  [TRANSFER OF OWNERSHIP.] The commissioner shall, 
  1.11  at the earliest feasible date after receiving payment, transfer 
  1.12  ownership of the parking facilities to the city of Minneapolis.  
  1.13  The payment must be equal to the amount of state funds spent by 
  1.14  the commissioner for construction of the facilities.  Upon 
  1.15  assuming ownership of the facilities, the city shall operate the 
  1.16  facilities in accordance with the rules adopted by the 
  1.17  commissioner under subdivision 2.  Upon assumption of ownership, 
  1.18  the city shall assume the authority to collect fees for use of 
  1.19  the facilities under subdivision 5.  The commissioner shall take 
  1.20  no action under this section that would result in federal 
  1.21  sanctions against Minnesota or require the repayment of any 
  1.22  state funds to the federal government.  The commissioner shall 
  1.23  deposit all money received under this subdivision in the trunk 
  1.24  highway fund. 
  1.25     [EFFECTIVE DATE.] This section is effective the day after 
  1.26  the governing body of the city of Minneapolis and its chief 
  2.1   clerical officer comply with Minnesota Statutes, section 
  2.2   645.021, subdivisions 2 and 3.
