  1.1                          A bill for an act 
  1.2             relating to MinnesotaCare; exempting chiropractors 
  1.3             from the MinnesotaCare provider tax; amending 
  1.4             Minnesota Statutes 1999 Supplement, section 295.50, 
  1.5             subdivision 4.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1999 Supplement, section 
  1.8   295.50, subdivision 4, is amended to read: 
  1.9      Subd. 4.  [HEALTH CARE PROVIDER.] (a) "Health care 
  1.10  provider" means: 
  1.11     (1) a person whose health care occupation is regulated or 
  1.12  required to be regulated by the state of Minnesota furnishing 
  1.13  any or all of the following goods or services directly to a 
  1.14  patient or consumer:  medical, surgical, optical, visual, 
  1.15  dental, hearing, nursing services, drugs, laboratory, diagnostic 
  1.16  or therapeutic services; 
  1.17     (2) a person who provides goods and services not listed in 
  1.18  clause (1) that qualify for reimbursement under the medical 
  1.19  assistance program provided under chapter 256B; 
  1.20     (3) a staff model health plan company; 
  1.21     (4) an ambulance service required to be licensed; or 
  1.22     (5) a person who sells or repairs hearing aids and related 
  1.23  equipment or prescription eyewear. 
  1.24     (b) Health care provider does not include: 
  1.25     (1) chiropractors; hospitals; medical supplies 
  2.1   distributors, except as specified under paragraph (a), clause 
  2.2   (5); nursing homes licensed under chapter 144A or licensed in 
  2.3   any other jurisdiction; pharmacies; surgical centers; bus and 
  2.4   taxicab transportation, or any other providers of transportation 
  2.5   services other than ambulance services required to be licensed; 
  2.6   supervised living facilities for persons with mental retardation 
  2.7   or related conditions, licensed under Minnesota Rules, parts 
  2.8   4665.0100 to 4665.9900; residential care homes licensed under 
  2.9   chapter 144B; board and lodging establishments providing only 
  2.10  custodial services that are licensed under chapter 157 and 
  2.11  registered under section 157.17 to provide supportive services 
  2.12  or health supervision services; adult foster homes as defined in 
  2.13  Minnesota Rules, part 9555.5105; day training and habilitation 
  2.14  services for adults with mental retardation and related 
  2.15  conditions as defined in section 252.41, subdivision 3; and 
  2.16  boarding care homes, as defined in Minnesota Rules, part 
  2.17  4655.0100; 
  2.18     (2) home health agencies as defined in Minnesota Rules, 
  2.19  part 9505.0175, subpart 15; a person providing personal care 
  2.20  services and supervision of personal care services as defined in 
  2.21  Minnesota Rules, part 9505.0335; a person providing private duty 
  2.22  nursing services as defined in Minnesota Rules, part 9505.0360; 
  2.23  and home care providers required to be licensed under chapter 
  2.24  144A; 
  2.25     (3) a person who employs health care providers solely for 
  2.26  the purpose of providing patient services to its employees; and 
  2.27     (4) an educational institution that employs health care 
  2.28  providers solely for the purpose of providing patient services 
  2.29  to its students if the institution does not receive fee for 
  2.30  service payments or payments for extended coverage. 
  2.31     Sec. 2.  [EFFECTIVE DATE.] 
  2.32     Section 1 is effective for revenue received on or after 
  2.33  July 1, 2000.
