  1.1                          A bill for an act 
  1.2             relating to crime prevention; prohibiting certain 
  1.3             types of racing; imposing criminal penalties; amending 
  1.4             Minnesota Statutes 2002, section 169.13, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 169.13, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 2a.  [UNLAWFUL RACING.] (a) As used in this 
  1.10  subdivision, "race" means the operation of one or more vehicles 
  1.11  in a competitive attempt to: 
  1.12     (1) outgain or outdistance another vehicle; 
  1.13     (2) arrive at a given destination ahead of another vehicle; 
  1.14     (3) engage in a speed or acceleration contest; 
  1.15     (4) set a speed record; or 
  1.16     (5) test the physical stamina or endurance of a driver or 
  1.17  drivers over long-distance driving routes. 
  1.18     (b) A person who drives a vehicle in a race or who 
  1.19  organizes or otherwise facilitates a race is guilty of a 
  1.20  misdemeanor. 
  1.21     (c) This subdivision does not apply to acts sanctioned by 
  1.22  an appropriate governmental entity that occur in areas that are 
  1.23  licensed or duly authorized by the entity as a racetrack, drag 
  1.24  strip, or designated racing area. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective August 1, 2004, and applies to acts 
  2.2   committed on or after that date.
