  1.1                          A bill for an act
  1.2             relating to education; requiring students to receive a 
  1.3             passing grade in postsecondary enrollment options 
  1.4             courses; amending Minnesota Statutes 2002, section 
  1.5             124D.09, subdivision 8. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 124D.09, 
  1.8   subdivision 8, is amended to read: 
  1.9      Subd. 8.  [LIMIT ON PARTICIPATION.] (a) A pupil who first 
  1.10  enrolls in grade 11 may not enroll in postsecondary courses 
  1.11  under this section for secondary credit for more than the 
  1.12  equivalent of two academic years.  A pupil who first enrolls in 
  1.13  grade 12 may not enroll in postsecondary courses under this 
  1.14  section for secondary credit for more than the equivalent of one 
  1.15  academic year.  If a pupil in grade 11 or 12 first enrolls in a 
  1.16  postsecondary course for secondary credit during the school 
  1.17  year, the time of participation shall be reduced 
  1.18  proportionately.  If a pupil is in a learning year or other 
  1.19  year-round program and begins each grade in the summer session, 
  1.20  summer sessions shall not be counted against the time of 
  1.21  participation.  A pupil who has graduated from high school 
  1.22  cannot participate in a program under this section.  A pupil who 
  1.23  has completed course requirements for graduation but who has not 
  1.24  received a diploma may participate in the program under this 
  1.25  section. 
  2.1      (b) A pupil, including an alternative pupil, who enrolls in 
  2.2   a postsecondary course for secondary or postsecondary credit 
  2.3   must receive a passing grade in the course to remain eligible to 
  2.4   enroll in any subsequent postsecondary course for credit.  The 
  2.5   principal or other chief administrator in the pupil's school may 
  2.6   excuse a pupil or an alternative pupil from this requirement if 
  2.7   the administrator determines that it is in the pupil's best 
  2.8   educational interest to do so. 
  2.9      [EFFECTIVE DATE.] This section is effective for the 
  2.10  2004-2005 school year and later.
