  1.1                          A bill for an act 
  1.2             relating to capital improvements; authorizing the sale 
  1.3             of state bonds; appropriating money for a variety of 
  1.4             water and land resource improvements. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [APPROPRIATION.] 
  1.7      Subdivision 1.  [NATURAL RESOURCES CAPITAL 
  1.8   PROJECTS.] $40,100,000 is appropriated from the bond proceeds 
  1.9   fund to the commissioner of natural resources for the capital 
  1.10  projects in subdivision 2, subject to the requirements of 
  1.11  Minnesota Statutes, section 16A.695. 
  1.12     Subd. 2.  [WATER AND LAND PROTECTION.] Of the amount 
  1.13  appropriated in subdivision 1: 
  1.14     (1) $12,000,000 is for habitat restoration for flood 
  1.15  prevention in the Red river watershed; 
  1.16     (2) $1,500,000 is for stream restoration projects that 
  1.17  employ natural channel design principles; 
  1.18     (3) $3,000,000 is for stream restoration by the removal of 
  1.19  outdated dams to restore fish spawning and migration and improve 
  1.20  water quality; 
  1.21     (4) $1,000,000 is for fisheries critical habitat to 
  1.22  purchase spawning areas and other critical fish habitat; 
  1.23     (5) $5,000,000 is for metropolitan greenways to protect, 
  1.24  restore, connect, and manage a Twin Cities metrowide network of 
  1.25  natural areas and open spaces along rivers and lakes; 
  2.1      (6) $2,000,000 is for the prairie banks program under 
  2.2   Minnesota Statutes, section 84.961; 
  2.3      (7) $6,000,000 is for state park land acquisition to 
  2.4   purchase critical lands within state park boundaries, from 
  2.5   willing sellers, allowing public access to state and adjacent 
  2.6   waters; 
  2.7      (8) $4,000,000 is for acquisition and restoration of 
  2.8   scientific and natural areas under Minnesota Statutes, section 
  2.9   84.033, to purchase lands and waters with natural features of 
  2.10  exceptional scientific and educational value; 
  2.11     (9) $3,000,000 is for local open space matching grants to 
  2.12  cities and counties to assist in the protection of open space 
  2.13  and natural areas with outstanding resource value; 
  2.14     (10) $2,000,000 is to acquire Seminary Fen in the 
  2.15  Assumption Creek watershed in Carver county, to be managed in 
  2.16  part as a scientific and natural area and in part as a wildlife 
  2.17  management area; and 
  2.18     (11) $600,000 is for the sealing of abandoned wells on 
  2.19  state land. 
  2.20     Sec. 2.  [BOARD OF WATER AND SOIL RESOURCES.] 
  2.21     $24,000,000 is appropriated from the bond proceeds fund to 
  2.22  the board of water and soil resources, subject to the 
  2.23  requirements of Minnesota Statutes, section 16A.695, and 
  2.24  distributed as provided in clauses (1) and (2): 
  2.25     (1) $14,000,000 is for payment under the reinvest in 
  2.26  Minnesota program under Minnesota Statutes, section 103F.515; 
  2.27  and 
  2.28     (2) $10,000,000 is for streambank, lakeshore, and erosion 
  2.29  control grants to permanently protect and revegetate targeted 
  2.30  shorelines in private ownership. 
  2.31     Sec. 3.  [POLLUTION CONTROL AGENCY.] 
  2.32     $13,000,000 is appropriated from the bond proceeds fund to 
  2.33  the commissioner of the pollution control agency for loans to 
  2.34  local government under the clean water partnership program in 
  2.35  Minnesota Statutes, section 103F.715, subject to the 
  2.36  requirements of Minnesota Statutes, section 16A.695.  Of this 
  3.1   amount, $3,000,000 is for "Brownfields to Greenspace" grants to 
  3.2   local governments to assess and clean up contaminated land for 
  3.3   conversion to parks and open space. 
  3.4      Sec. 4.  [DEPARTMENT OF AGRICULTURE.] 
  3.5      $2,300,000 is appropriated from the bond proceeds fund to 
  3.6   the commissioner of agriculture, subject to the requirements of 
  3.7   Minnesota Statutes, section 16A.695, and distributed as provided 
  3.8   in clauses (1) and (2): 
  3.9      (1) $2,000,000 is for loans to farmers to implement best 
  3.10  management practices to reduce impacts from feedlots on lakes, 
  3.11  rivers, and streams; and 
  3.12     (2) $300,000 is for the construction of an environmentally 
  3.13  friendly, swine farrowing demonstration facility of deep-bedded 
  3.14  straw at the University of Minnesota at Morris. 
  3.15     Sec. 5.  [BOND SALE.] 
  3.16     To provide the money appropriated in sections 1 to 4 from 
  3.17  the bond proceeds fund, the commissioner of finance shall sell 
  3.18  and issue bonds of the state in an amount up to $79,400,000 in 
  3.19  the manner, on the terms, and with the effect prescribed by 
  3.20  Minnesota Statutes, sections 16A.631 to 16A.675, and by the 
  3.21  Minnesota Constitution, article XI, sections 4 to 7. 
  3.22     Sec. 6.  [TITLE.] 
  3.23     This act may be cited as the "Protect Our Water Act of 
  3.24  2002." 
  3.25     Sec. 7.  [EFFECTIVE DATE.] 
  3.26     Sections 1 to 6 are effective the day after their final 
  3.27  enactment.
