  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing the sale of 
  1.3             certain tax-forfeited lands in Aitkin, Anoka, Crow 
  1.4             Wing, Faribault, Hubbard, St. Louis, Sherburne, 
  1.5             Wadena, and Washington counties; authorizing the sale 
  1.6             of certain trust land in Crow Wing county; requiring 
  1.7             the conveyance of certain state land to the city of 
  1.8             Hastings. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [PUBLIC SALE OF TAX-FORFEITED LAND BORDERING ON 
  1.11  PUBLIC WATER; WADENA COUNTY.] 
  1.12     Subdivision 1.  [SALE REQUIREMENTS.] (a) Notwithstanding 
  1.13  Minnesota Statutes, sections 92.45 and 282.018, subdivision 1, 
  1.14  Wadena county may sell the tax-forfeited lands bordering public 
  1.15  water that are described in subdivision 2 under the remaining 
  1.16  provisions of Minnesota Statutes, chapter 282. 
  1.17     (b) The county has determined that the county's land 
  1.18  management interests would best be served if the lands were 
  1.19  returned to private ownership. 
  1.20     (c) The conveyances must be in a form approved by the 
  1.21  attorney general and must reserve to the state an easement 66 
  1.22  feet in width, measured from the ordinary high water level of 
  1.23  Union Creek, for trout stream management. 
  1.24     Subd. 2.  [DESCRIPTIONS.] The lands that may be conveyed 
  1.25  are located in Wadena county and are legally described as 
  1.26  follows: 
  1.27     (1) City of Wadena (Parcel No. 22700080), Lot Eight (8), 
  2.1   Block One (1), Winkels Addition to Wadena, according to the plat 
  2.2   on file in the office of the Wadena County Recorder; 
  2.3      (2) City of Wadena (Parcel No. 227700100), Lot Ten (10), 
  2.4   Block One (1), Winkels Addition to Wadena, according to the plat 
  2.5   on file in the office of the Wadena County Recorder; and 
  2.6      (3) City of Wadena (Parcel No. 227700120), Lot Twelve (12), 
  2.7   Block One (1), Winkels Additions to Wadena, according to the 
  2.8   plat on file in the office of the Wadena County Recorder. 
  2.9      Sec. 2.  [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 
  2.10  PUBLIC WATER; ANOKA COUNTY.] 
  2.11     Subdivision 1.  [SALE REQUIREMENTS.] (a) Notwithstanding 
  2.12  Minnesota Statutes, sections 92.45 and 282.018, subdivision 1, 
  2.13  Anoka county may convey the tax-forfeited lands bordering public 
  2.14  water that are described in subdivision 2 under the remaining 
  2.15  provisions of Minnesota Statutes, chapter 282. 
  2.16     (b) The county has determined that the county's land 
  2.17  management interests would best be served if the lands were sold 
  2.18  to the cities in which they are located. 
  2.19     (c) The conveyances must be in a form approved by the 
  2.20  attorney general and must provide that the lands revert to the 
  2.21  state if they are not used for open space purposes. 
  2.22     (d) No landscape changes, stormwater discharge, or 
  2.23  watercourse alterations that affect the hydrology and vegetative 
  2.24  characteristics of the lands are allowed beyond those conditions 
  2.25  that exist at the time of the transfer or sale in order that the 
  2.26  wetland characteristics and resulting wildlife habitats are 
  2.27  maintained in perpetuity. 
  2.28     Subd. 2.  [DESCRIPTIONS.] The lands that may be conveyed 
  2.29  are located in Anoka county and are legally described as follows:
  2.30     (1) City of Anoka (PIN No. 35-32-25-31-0003), all that part 
  2.31  of the Northeast Quarter of the Southwest Quarter of Section 35, 
  2.32  Township 32, Range 25, Anoka County, Minnesota lying southerly 
  2.33  of the centerline of a creek, said centerline being described as 
  2.34  follows: 
  2.35     Commencing at a point on the east line of Government Lot 2, 
  2.36  Section 35, Township 32, Range 25 distant 120 feet north from 
  3.1   the southeast corner of said Government Lot 2; thence northerly 
  3.2   along the east line of said Government Lot 2, said line having a 
  3.3   bearing of North and South, for a distance of 1083.00 feet to 
  3.4   the centerline of creek; thence North 44 degrees 58 minutes 20 
  3.5   seconds West a distance of 97.29 feet; thence North 67 degrees 
  3.6   56 minutes 46 seconds West a distance of 138.64 feet; thence 
  3.7   North 75 degrees 56 minutes 46 seconds West a distance of 216.92 
  3.8   feet; thence South 89 degrees 39 minutes 55 seconds West a 
  3.9   distance of 180.17 feet; thence South 57 degrees 56 minutes 35 
  3.10  seconds West a distance of 416.78 feet; thence South 70 degrees 
  3.11  54 minutes 50 seconds West a distance of 283.00 feet, more or 
  3.12  less, to its intersection with the northerly shore line of the 
  3.13  Mississippi River extended southeasterly across said creek 
  3.14  centerline and there terminating. 
  3.15     Also known as part of Lot 26, Auditor's Subdivision No. 96, 
  3.16  Anoka County, Minnesota. 
  3.17     And all that part of said Lot 26, Auditor's Subdivision No. 
  3.18  96, Anoka County, Minnesota lying northerly of said centerline 
  3.19  of creek, lying southerly of the south line of Lot 31, said 
  3.20  Auditor's Subdivision No. 96, and lying easterly of the west 
  3.21  line of said Lot 31 extended southerly to said centerline of 
  3.22  creek. 
  3.23     (2) City of Anoka (PIN No. 35-32-25-31-0006), Lot 31, 
  3.24  Auditor's Subdivision No. 96, Anoka County, Minnesota, according 
  3.25  to the plat on file in the office of the Anoka County Recorder. 
  3.26     (3) City of Anoka (PIN No. 35-32-25-34-0001), all that part 
  3.27  of Government Lot 2, Section 35, Township 32, Range 25, Anoka 
  3.28  County, Minnesota lying southerly of a line hereinafter referred 
  3.29  to as line "B," said line "B" being described as follows: 
  3.30     Beginning at the intersection of the southwesterly line of 
  3.31  Lot 14, Auditor's Subdivision No. 96, Anoka County, Minnesota 
  3.32  and a line parallel with and 150.00 feet northwesterly of the 
  3.33  southeasterly line of said Lot 14; thence southwesterly along 
  3.34  said parallel line and its southwesterly extension 500.00 feet; 
  3.35  thence southwesterly deflecting to the right 45 degrees 00

  4.31     (4) City of Anoka (PIN No. 35-32-25-43-0001), all that part 
  4.32  of the Northwest Quarter of the Southeast Quarter and the South 
  4.33  Half of the Southeast Quarter of Section 35, Township 32, Range 
  4.34  25, Anoka County, Minnesota lying southwesterly of the 
  4.35  southwesterly right-of-way line of U.S. Highway No. 10.  Also

  5.1      Except that part of the South Half of the Southeast Quarter 
  5.2   of Section 35, Township 32, Range 25 described as follows: 
  5.3      Beginning at the point of intersection of the southwesterly

  5.34  degrees 08 minutes East along the north line of said Otter Lake 
  5.35  Hills extended easterly, 1083.60 feet to the centerline of Bald 
  5.36  Eagle Boulevard as traveled; thence South 24 degrees 28 minutes 
  6.1   West, 418.80 feet; thence South 05 degrees 22 minutes East, 
  6.2   395.65 feet on said centerline for point of beginning of line to

  6.6      Excepting therefrom that part of the south 325.00 feet of 
  6.7   the north 534.00 feet of said Government Lot 2 lying easterly of 
  6.8   the westerly 675.00 feet thereof; subject to and together with 
  6.9   that cartway easement hereinbefore described and to Bald Eagle 
  6.10  Boulevard, and other easements and reservations of record, if 
  6.11  any. 
  6.12     (6) City of Ramsey (PIN No. 25-32-25-34-0061), Outlot O, 
  6.13  Flintwood Hills 2nd Addition, Anoka County, Minnesota, according 
  6.14  to the plat on file in the office of the Anoka County Recorder. 
  6.15     (7) City of Ramsey (PIN No. 21-32-25-43-0034), the east 
  6.16  290.00 feet of the west 1168.00 feet of the south 330.00 feet of 
  6.17  the north 1705.00 feet of the Southeast Quarter of Section 21, 
  6.18  Township 32, Range 25, Anoka County, Minnesota. 
  6.19     And the south 165.00 feet of the north 1540.00 feet of the 
  6.20  east 105.00 feet of the west 1273.00 feet of said Southeast 
  6.21  Quarter.  Subject to road easement over the north 33.00 feet 
  6.22  thereof. 
  6.23     (8) City of Oak Grove (PIN No. 32-33-24-41-0001), all that 
  6.24  part of the Northeast Quarter of the Southeast Quarter of 
  6.25  Section 32, Township 33, Range 24, Anoka County, Minnesota lying 
  6.26  southerly of the centerline of Cedar Creek and lying easterly of 
  6.27  the following described line: 
  6.28     Commencing at the southeast corner of said Northeast 
  6.29  Quarter of the Southeast Quarter; thence North 89 degrees 37 
  6.30  minutes 27 seconds West along the south line of said Northeast 
  6.31  Quarter of the Southeast Quarter 299.44 feet to the point of 
  6.32  beginning of said line; thence North 18 degrees 06 minutes 51 
  6.33  seconds West to said centerline of Cedar Creek and there 
  6.34  terminating. 
  6.35     (9) City of Andover (PIN No. 29-32-24-42-0055), Outlot A, 
  6.36  Brandon's Lakeview Estates, Anoka County, Minnesota, according 
  7.1   to the plat on file in the office of the Anoka County Recorder.  
  7.2      Sec. 3.  [CONVEYANCE OF TAX-FORFEITED LAND, FARIBAULT 
  7.3   COUNTY.] 
  7.4      Subdivision 1.  [CONVEYANCE.] (a) Notwithstanding Minnesota 
  7.5   Statutes, sections 92.45 and 282.018, subdivision 1, Faribault 
  7.6   county may sell the tax-forfeited land bordering public water 
  7.7   that is described in subdivision 2 under the remaining 
  7.8   provisions of Minnesota Statutes, chapter 282.  
  7.9      (b) The county has determined that it is in the public's 
  7.10  best interest to sell the parcels to the city of Minnesota Lake 
  7.11  for street right-of-way and for residential development.  
  7.12     (c) The conveyance must be in a form approved by the 
  7.13  attorney general.  
  7.14     Subd. 2.  [DESCRIPTION.] The land that may be conveyed is 
  7.15  located in Faribault county and is described as:  
  7.16     Lots 3 and 4, Nordaas Subdivision No. 3, Minnesota Lake, 
  7.17     Faribault County, Minnesota.  
  7.18     Sec. 4.  [ST. LOUIS COUNTY; PRIVATE SALE OF TAX-FORFEITED 
  7.19  LAND.] 
  7.20     (a) Notwithstanding the public sale provisions of Minnesota 
  7.21  Statutes, chapter 282, St. Louis county may sell the land in St. 
  7.22  Louis county described in this section by private sale under the 
  7.23  remaining provisions of Minnesota Statutes, chapter 282. 
  7.24     (b) The conveyance must be in a form approved by the 
  7.25  attorney general. 
  7.26     (c) The land that may be sold is described as: 
  7.27     Town of Floodwood:  NE 1/4 of SE 1/4, Section 36, Township 
  7.28  51, Range 20.  The sale is in the public interest. 
  7.29     Sec. 5.  [SALE OF TAX-FORFEITED LAND; AITKIN COUNTY.] 
  7.30     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  7.31  282.018, subdivision 1, Aitkin county may sell the tax-forfeited 
  7.32  lands bordering public water that are described in paragraph 
  7.33  (c), under the remaining provisions of Minnesota Statutes, 
  7.34  chapter 282. 
  7.35     (b) The conveyance must be in a form approved by the 
  7.36  attorney general. 
  8.1      (c) The lots that may be conveyed are located in Aitkin 
  8.2   county and are described as: 
  8.3      (1) plat of Black Rock Woods, lots 2 and 3, block 1, city 
  8.4   of Aitkin; and 
  8.5      (2) plat of Ripple View Development, lot 1, block 2, city 
  8.6   of Aitkin.  
  8.7      (d) The county has determined that the county's land 
  8.8   management interests would best be served if the lands were 
  8.9   returned to private ownership. 
  8.10     Sec. 6.  [SALE OF TAX-FORFEITED LAND; CROW WING COUNTY.] 
  8.11     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  8.12  282.018, subdivision 1, Crow Wing county may sell tax-forfeited 
  8.13  land bordering public water that is described in paragraph (c) 
  8.14  to the owner of adjoining land under the remaining provisions of 
  8.15  Minnesota Statutes, chapter 282. 
  8.16     (b) The conveyance must be in a form approved by the 
  8.17  attorney general and must provide that the land reverts to the 
  8.18  state if the purchaser, or any successor to the purchaser, 
  8.19  conveys the land as a separate parcel. 
  8.20     (c) The land that may be sold is located in Crow Wing 
  8.21  county and is described as:  Lot one (1), Block three (3), 
  8.22  central addition No. 2 to Crosby, RE:  111000030010009. 
  8.23     (d) The size of the lot is 40 feet by 105 feet, but the 
  8.24  water frontage exceeds 50 feet due to a meandering creek. 
  8.25     (e) The county has determined the land should be returned 
  8.26  to private ownership. 
  8.27     Sec. 7.  [SALE OF TAX-FORFEITED LAND; HUBBARD COUNTY.] 
  8.28     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  8.29  282.018, subdivision 1, Hubbard county may sell the 
  8.30  tax-forfeited land bordering public water that is described in 
  8.31  paragraph (c), under the remaining provisions of Minnesota 
  8.32  Statutes, chapter 282. 
  8.33     (b) The conveyance must be in a form approved by the 
  8.34  attorney general. 
  8.35     (c) The land that may be conveyed is located in Hubbard 
  8.36  county, consists of four lots plus interests in an outlot 
  9.1   located on Tenth Crow Wing Lake, and is described as: 
  9.2      (1) Crowsnest Lot Eight (8), Block Two (2) and 1/38 
  9.3   Interest in Outlot A; 
  9.4      (2) Crowsnest Lot Fourteen (14), Block Three (3) and 1/38 
  9.5   Interest in Outlot A; 
  9.6      (3) Crowsnest Lot One (1), Block Three (3) and 1/38 
  9.7   Interest in Outlot A; and 
  9.8      (4) Crowsnest Lot Fifteen (15), Block Three (3) and 1/38 
  9.9   Interest in Outlot A. 
  9.10     (d) The county has determined that the lake has a developed 
  9.11  public access, the lots are best suited for residential 
  9.12  purposes, and the county's land management interests would best 
  9.13  be served if the lands were returned to private ownership. 
  9.14     Sec. 8.  [PRIVATE SALE OF TAX-FORFEITED LAND; WASHINGTON 
  9.15  COUNTY.] 
  9.16     (a) Notwithstanding the public sale provisions of Minnesota 
  9.17  Statutes, chapter 282, Washington county may convey by private 
  9.18  sale the tax-forfeited land that is described in paragraph (c), 
  9.19  under the remaining provisions of Minnesota Statutes, chapter 
  9.20  282. 
  9.21     (b) The land described in paragraph (c) may be sold by 
  9.22  private sale to the owners at the time of the forfeiture.  The 
  9.23  conveyance must be in a form approved by the attorney general 
  9.24  for a consideration equal to the aggregate of delinquent taxes 
  9.25  and assessments computed under Minnesota Statutes, section 
  9.26  282.251, together with penalties, interest, and costs that 
  9.27  accrued or would have accrued if the property had not forfeited 
  9.28  to the state. 
  9.29     (c) The land that may be conveyed consists of two parcels 
  9.30  in the city of Forest Lake, identified as PID Numbers 32288-2120 
  9.31  and 32288-2125, that forfeited for failure to pay taxes on 
  9.32  August 17, 1994. 
  9.33     (d) The owners of the property, which was used to provide 
  9.34  garage units for residential property, were not notified of the 
  9.35  tax delinquency and forfeiture because the names on the notices 
  9.36  required under law to be sent to persons with an interest in the 
 10.1   property were addressed to the wrong person. 
 10.2      Sec. 9.  [CONVEYANCE OF STATE LAND TO THE CITY OF 
 10.3   HASTINGS.] 
 10.4      (a) Notwithstanding Minnesota Statutes, chapter 94, the 
 10.5   commissioner of administration shall convey the land described 
 10.6   in paragraph (c) to the city of Hastings for no consideration. 
 10.7      (b) The conveyance must be in a form approved by the 
 10.8   attorney general and must provide that the land reverts to the 
 10.9   state if it is not used for park or open space purposes. 
 10.10     (c) The land to be conveyed is described as follows: 
 10.11     That part of the SE 1/4 of the SE 1/4 of Section 27 all in 
 10.12  the Township 115 North, Range 17 West, described as follows: 
 10.13     Commencing at the SE corner of Section 27, T115N, R17W, 
 10.14  that point also being the NE corner of Section 34, T115N, R17W; 
 10.15  thence S 0 degrees 57 minutes 58 seconds E bearing assumed along 
 10.16  the east line of said Section 34, a distance of 787.06 feet, 
 10.17  said point being on the center line of State Trunk Highway No. 
 10.18  291; thence S 86 degrees 15 minutes 45 seconds W, along said 
 10.19  center line, a distance of 345.69 feet; thence on a tangential 
 10.20  curve, concave to the south, having a radius of 1340.66 feet, a 
 10.21  central angle of 13 degrees 36 minutes 06 seconds, a distance of 
 10.22  318.27 feet; thence S 72 degrees 39 minutes 39 seconds W a 
 10.23  distance of 58.26 feet; thence on a tangential curve, concave to 
 10.24  the north, having a radius of 2646.12 feet, a central angle of 3

 11.11  beginning. 
 11.12     (d) The veterans homes board has determined that it no 
 11.13  longer has any use for the property, which is surrounded by land 
 11.14  owned by the city of Hastings. 
 11.15     Sec. 10.  [SALE OF TAX-FORFEITED LAND; SHERBURNE COUNTY.] 
 11.16     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
 11.17  282.018, subdivision 1, Sherburne county may sell the 
 11.18  tax-forfeited land bordering public water that is described in 
 11.19  paragraph (c), under the remaining provisions of Minnesota 
 11.20  Statutes, chapter 282, subject to any additional conditions or 
 11.21  limitations provided in this section. 
 11.22     (b) The conveyance must be in a form approved by the 
 11.23  attorney general. 
 11.24     (c) The lands that may be conveyed are located in Sherburne 
 11.25  county described as follows: 
 11.26     (1) That part of government Lot 5 described as follows:  
 11.27  North 200 feet of the South 300 feet of that part of said 
 11.28  Government Lot 5 that lies between the Township Road running in 
 11.29  a Northerly and Southerly direction across said Government Lot 5 
 11.30  and the brook running across said Lot 5 in Section 30, Township 
 11.31  35, Range 26, Baldwin Township, to be subject to reversion to 
 11.32  the state if the purchaser of the land is the owner of adjoining 
 11.33  land, and the purchaser, or any successor to the purchaser, 
 11.34  subsequently conveys the land separately from the adjoining land.
 11.35     (2) That part of the East Half of the Northeast Quarter of 
 11.36  Section 24, Township 35, Range 27, described as follows:  
 12.1   Beginning at a point on the East Line of said Northeast Quarter 
 12.2   894 feet South of the Northeast Corner of said Northeast 
 12.3   Quarter; thence in a Southwesterly direction to a point on the 
 12.4   West Line of said East Half of Northeast Quarter a distance of 
 12.5   756 feet North of the Southwest corner of said East Half of 
 12.6   Northeast Quarter; thence South along said West Line a distance 
 12.7   of 756 feet to the Southwest corner thereof; thence East along 
 12.8   said South Line of said East Half of Northeast Quarter to the 
 12.9   Southeast Corner of said East Half of Northeast Quarter; thence 
 12.10  North along said East Line to the point of beginning, excepting 
 12.11  therefrom the following described tract:  Beginning at the 
 12.12  Southeast corner of said East Half of Northeast Quarter; thence 
 12.13  North along the East Line of said East Half of Northeast Quarter 
 12.14  a distance of 650 feet; thence West parallel with the South Line 
 12.15  thereof a distance of 580 feet; thence South parallel with the 
 12.16  East Line of Northeast Quarter a distance of 650 feet to the 
 12.17  South Line thereof; thence East along said South Line a distance 
 12.18  of 580 feet to the point of beginning.  This parcel is to be 
 12.19  subject to reversion to the state if any of the following events 
 12.20  occur: 
 12.21     (i) permanent buildings are built on the land; or 
 12.22     (ii) fill is placed on the land. 
 12.23     (3) That part of Government Lot 3, Section 3, Township 34, 
 12.24  Range 29, lying North of the Elk River, Clear Lake Township, to 
 12.25  be subject to reversion to the state if any of the following 
 12.26  events occur: 
 12.27     (i) permanent buildings are built on the land; or 
 12.28     (ii) fill is placed on the land. 
 12.29     (4) Lot 25, Block 1, Ann Lake Beach in Section 15, Township 
 12.30  34, Range 29, Orrock Township, to be subject to reversion to the 
 12.31  state if the purchaser of the land is the owner of adjoining 
 12.32  land, and the purchaser, or any successor to the purchaser, 
 12.33  subsequently conveys the land separately from the adjoining land.
 12.34     (5) The East Half of the Southeast Quarter of Section 3, 
 12.35  Township 35 North, Range 29 West in Palmer Township. 
 12.36     (6) Outlot A, Second Fremont Lake Shores, Section 9, 
 13.1   Township 34, Range 26, City of Zimmerman, to be subject to 
 13.2   reversion to the state if: 
 13.3      (i) fill is placed on the land; or 
 13.4      (ii) the purchaser of the land is the owner of adjoining 
 13.5   land, and the purchaser, or any successor to the purchaser, 
 13.6   subsequently conveys the land separately from the adjoining land.
 13.7      (d) The county has determined that the county's land 
 13.8   management interests would best be served if these lands were 
 13.9   returned to private ownership. 
 13.10     Sec. 11.  [SALE OF STATE SCHOOL TRUST LAND.] 
 13.11     (a) Notwithstanding Minnesota Statutes, section 89.01, 
 13.12  subdivision 5, the commissioner of natural resources may sell as 
 13.13  otherwise provided by law the parcel of state school trust land 
 13.14  described in paragraph (c). 
 13.15     (b) The conveyance must be in a form approved by the 
 13.16  attorney general. 
 13.17     (c) The land that may be sold is in Crow Wing county and is 
 13.18  described as: 
 13.19     That part of the Northeast Quarter of the Northeast Quarter 
 13.20  of Section 36, Township 136, Range 28, Crow Wing County, 
 13.21  Minnesota described as follows: 
 13.22     Beginning at the northwest corner of the Northeast Quarter 
 13.23  of the Northeast Quarter of said Section 36; thence South 85 
 13.24  degrees 10 minutes 00 seconds East, assumed bearing along the 
 13.25  north line of said Northeast Quarter of the Northeast Quarter 
 13.26  1355.56 feet to the northeast corner of said Northeast Quarter 
 13.27  of the Northeast Quarter, also being the centerline of a 
 13.28  Township Road; thence North 89 degrees 50 minutes 32 seconds 
 13.29  West along the centerline of said Township Road a distance of 
 13.30  899.40 feet; thence North 89 degrees 38 minutes 31 seconds West 
 13.31  along said centerline a distance of 451.28 feet to the west line 
 13.32  of said Northeast Quarter of the Northeast Quarter; thence North 
 13.33  0 degrees 02 minutes 00 seconds West along the west line of said 
 13.34  Northeast Quarter of the Northeast Quarter a distance of 108.91 
 13.35  feet to the point of beginning. 
 13.36     Subject to easements for township roads and other 
 14.1   easements, reservations or restrictions of record, if any. 
 14.2      (d) The commissioner of natural resources has determined 
 14.3   due to recent survey information and the township road location 
 14.4   and easement that the parcel is not suitable for public land 
 14.5   management. 
 14.6      Sec. 12.  [EFFECTIVE DATE.] 
 14.7      This act is effective the day following final enactment.
