  1.1                          A bill for an act 
  1.2             relating to education; consolidating uses of basic 
  1.3             skills revenue; requiring a school district to 
  1.4             collaborate with the school site decision-making team 
  1.5             in allocating compensatory education revenue; amending 
  1.6             Minnesota Statutes 2000, section 126C.15, subdivision 
  1.7             3; Minnesota Statutes 2001 Supplement, section 
  1.8             126C.15, subdivision 1.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2001 Supplement, section 
  1.11  126C.15, subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [USE OF THE REVENUE.] The basic skills 
  1.13  revenue under section 126C.10, subdivision 4, and the portion of 
  1.14  the transition revenue adjustment under section 126C.10, 
  1.15  subdivision 20, attributable to the compensatory transition 
  1.16  allowance under section 126C.10, subdivision 19, paragraph (b), 
  1.17  must be reserved and used to meet the educational needs of 
  1.18  pupils who enroll under-prepared to learn and whose progress 
  1.19  toward meeting state or local content or performance standards 
  1.20  is below the level that is appropriate for learners of their 
  1.21  age.  Any of the following may be provided to meet these 
  1.22  learners' needs: 
  1.23     (1) direct instructional services under the assurance of 
  1.24  mastery program according to section 124D.66; 
  1.25     (2) remedial instruction in reading, language arts basic 
  1.26  communication skills, mathematics, other content areas science, 
  1.27  social studies, or study skills to improve the achievement level 
  2.1   of these learners; 
  2.2      (2) language programs for learners of limited English 
  2.3   proficiency that include, among other things, interpretation and 
  2.4   translation services; 
  2.5      (3) academic instructional materials and technology 
  2.6   appropriate for meeting the individual needs of these learners; 
  2.7      (4) academic programs during an extended school day, 
  2.8   extended school week, extended school year, or summer school 
  2.9   program offered directly by the site or under a contract 
  2.10  premised on academic achievement with a community-based 
  2.11  organization; 
  2.12     (5) all-day everyday kindergarten; 
  2.13     (6) additional teachers and teacher aides to provide more 
  2.14  individualized instruction to these learners through individual 
  2.15  tutoring, or lower instructor-to-learner ratios, or team 
  2.16  teaching; 
  2.17     (4) a longer school day or week during the regular school 
  2.18  year or through a summer program that may be offered directly by 
  2.19  the site or under a performance-based contract with a 
  2.20  community-based organization; 
  2.21     (5) comprehensive and ongoing staff development consistent 
  2.22  with district and site plans according to section 122A.60, for 
  2.23  teachers, teacher aides, principals, and other personnel to 
  2.24  improve their ability to identify the needs of these learners 
  2.25  and provide appropriate remediation, intervention, 
  2.26  accommodations, or modifications; 
  2.27     (6) instructional materials and technology appropriate for 
  2.28  meeting the individual needs of these learners; and 
  2.29     (7) programs to reduce truancy., encourage completion of 
  2.30  high school, enhance self-concept, provide health services, 
  2.31  provide nutrition services, provide a safe and secure learning 
  2.32  environment, provide coordination for pupils receiving services 
  2.33  from other governmental agencies, provide psychological services 
  2.34  to determine the level of social, emotional, cognitive, and 
  2.35  intellectual development, and provide counseling services, 
  2.36  guidance services, and social work services; 
  3.1      (8) bilingual programs, bicultural programs, and programs 
  3.2   for learners of limited English proficiency; 
  3.3      (9) all day kindergarten; 
  3.4      (10) extended school day and extended school year programs; 
  3.5   and 
  3.6      (11) substantial parent involvement in developing and 
  3.7   implementing remedial education or intervention plans for a 
  3.8   learner, including learning contracts between the school, the 
  3.9   learner, and the parent that establish achievement goals and 
  3.10  responsibilities of the learner and the learner's parent or 
  3.11  guardian. 
  3.12     [EFFECTIVE DATE.] This section is effective for the 
  3.13  2002-2003 school year and later.  
  3.14     Sec. 2.  Minnesota Statutes 2000, section 126C.15, 
  3.15  subdivision 3, is amended to read: 
  3.16     Subd. 3.  [RECOMMENDATION COLLABORATION.] A school district 
  3.17  must collaborate with the school site decision-making team, as 
  3.18  defined in section 123B.04, subdivision 2, paragraph (a), or the 
  3.19  instruction and curriculum advisory committee under section 
  3.20  120B.11, if the school has no school site decision team, shall 
  3.21  recommend when determining how the compensatory education 
  3.22  revenue will be used to carry out the purpose of this section. 
  3.23     [EFFECTIVE DATE.] This section is effective for the 
  3.24  2002-2003 school year and later. 
  3.25     Sec. 3.  [REVISOR INSTRUCTION.] 
  3.26     In the next and subsequent editions of Minnesota Statutes, 
  3.27  the revisor shall change the term "compensatory revenue" and 
  3.28  similar terms to "remedial revenue." 
  3.29     [EFFECTIVE DATE.] This section is effective the day 
  3.30  following final enactment.
