  1.1                          A bill for an act 
  1.2             relating to railroads; restricting remote-control 
  1.3             operation of train over highway intersection; amending 
  1.4             Minnesota Statutes 2002, section 219.383, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 219.383, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 5.  [REMOTE-CONTROL OPERATION OVER GRADE 
  1.10  CROSSING.] In accordance with United States Code, title 49, 
  1.11  section 20106, a railway corporation shall not allow the 
  1.12  remote-control operation of a railroad engine or other railroad 
  1.13  equipment moving across a grade crossing unless its movement is 
  1.14  preceded by a crew member or other human operator who is on or 
  1.15  ahead of movement and physically at the grade crossing at the 
  1.16  time, with an unobstructed view of any approaching vehicles or 
  1.17  pedestrians.  For purposes of this subdivision, the distance of 
  1.18  unobstructed view must be determined by the speed of the engine 
  1.19  or equipment and the physical characteristics of the grade 
  1.20  crossing, but not less than 300 feet when practicable.
