  1.1                          A bill for an act 
  1.2             relating to civil actions; creating immunity for 
  1.3             placement of water buoys; proposing coding for new law 
  1.4             in Minnesota Statutes, chapter 604A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [604A.245] [PLACEMENT OF WATER BUOYS.] 
  1.7      An individual or a private association under the direction 
  1.8   of the local sheriff that places a buoy in public waters is not 
  1.9   civilly liable for placement of the buoy if the placement was in 
  1.10  good faith and did not constitute willful or reckless 
  1.11  misconduct.  This section does not restrict or affect immunity 
  1.12  from liability that may be available under other law. 
  1.13     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.14     Section 1 is effective August 1, 2000, and applies to 
  1.15  claims arising from incidents occurring on or after that date.
