  1.1                          A bill for an act 
  1.2             relating to transportation; transferring money to 
  1.3             highway user tax distribution fund; designating 
  1.4             portion of appropriation for right-of-way acquisition; 
  1.5             authorizing state bonds and appropriating money for 
  1.6             local bridge replacement and rehabilitation. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [TRANSFER TO HIGHWAY USER TAX DISTRIBUTION 
  1.9   FUND.] 
  1.10     $200,000,000 is transferred from the general fund to the 
  1.11  highway user tax distribution fund.  Of this amount, no less 
  1.12  than 50 percent of the amount apportioned by the Minnesota 
  1.13  Constitution to the trunk highway fund must be used for 
  1.14  acquisition of lands and properties necessary to locate, 
  1.15  construct, reconstruct, improve, and maintain the trunk highway 
  1.16  system. 
  1.17     Sec. 2.  [APPROPRIATION.] 
  1.18     $50,000,000 is appropriated to the commissioner of 
  1.19  transportation from the state transportation fund as provided in 
  1.20  Minnesota Statutes, section 174.50, to match federal funds and 
  1.21  to replace or rehabilitate local deficient bridges.  Political 
  1.22  subdivisions may use grants made under this section to construct 
  1.23  or reconstruct bridges, including: 
  1.24     (1) matching federal aid grants to construct or reconstruct 
  1.25  key bridges; 
  1.26     (2) paying the costs of preliminary engineering and 
  2.1   environmental studies authorized under Minnesota Statutes, 
  2.2   section 174.50, subdivision 6a; 
  2.3      (3) paying the costs to abandon an existing bridge that is 
  2.4   deficient and in need of replacement, but where no replacement 
  2.5   will be made; and 
  2.6      (4) paying the costs to construct a road or street to 
  2.7   facilitate the abandonment of an existing bridge determined by 
  2.8   the commissioner to be deficient, if the commissioner determines 
  2.9   that construction of the road or street is more cost efficient 
  2.10  than the replacement of the existing bridge. 
  2.11     Sec. 3.  [BOND SALE.] 
  2.12     To provide the money appropriated by section 2 from the 
  2.13  state transportation fund, the commissioner of finance, on 
  2.14  request of the governor, shall sell and issue bonds of the state 
  2.15  in an amount up to $50,000,000 in the manner, on the terms, and 
  2.16  with the effect prescribed by Minnesota Statutes, sections 
  2.17  16A.631 to 16A.675, and by the Minnesota Constitution, article 
  2.18  XI, sections 4 to 7.  The proceeds of the bonds, except accrued 
  2.19  interest and any premium received on the sale of the bonds, must 
  2.20  be credited to a bond proceeds account in the state 
  2.21  transportation fund. 
  2.22     Sec. 4.  [EFFECTIVE DATE.] 
  2.23     Section 1 is effective July 1, 2000.  Sections 2 and 3 are 
  2.24  effective the day after final enactment.
