A bill for an act
relating to higher education; providing for the disposition of surplus Minnesota
State Colleges and Universities property adjacent to a school district; amending
Minnesota Statutes 2005 Supplement, section 136F.60, subdivision 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2005 Supplement, section 136F.60, subdivision 5,
is amended to read:


Subd. 5.

Disposition of surplus property.

(a) The board may declare state
lands under its control that are no longer needed by the Minnesota State Colleges and
Universities system to be surplus andnew text begin , except for surplus lands under paragraph (b), new text end may
offer them for public sale in a manner consistent with the procedures set forth in sections
16B.282 to 16B.286 for disposition of state lands by the commissioner of administration.
The parcels must not be exchanged or transferred for no or nominal consideration.

(b) new text begin Notwithstanding section 16B.282, subdivision 1, paragraph (c), any land that
was transferred to a campus from a vocational technical institution that is declared surplus
by the board must first be offered to the school district that established the vocational
technical institution. The school district has the right to purchase the surplus land at a
price that must not exceed the costs incurred by the campus responsible for management
of the land for capital improvements excluding the costs of routine capital maintenance. If
the school district chooses not to purchase the land, the commissioner of administration
must offer it for public sale under sections 16B.282 to 16B.286.

new text begin (c) new text end Proceeds from the sale or disposition of land under this subdivision, after paying
all expenses incurred in selling or disposing of the land and then paying any amounts due
under section 16A.695, are appropriated to the board for use for capital projects at the
institution that was responsible for management of the land.
