  1.1                          A bill for an act 
  1.2             relating to civil commitment; requiring the state to 
  1.3             give counties a one-year notice prior to releasing a 
  1.4             level 3 sex offender; amending Minnesota Statutes 
  1.5             2002, section 253B.185, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 253B.185, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 5a.  [NOTICE REQUIRED PRIOR TO RELEASE OF LEVEL 3 SEX 
  1.10  OFFENDER; COSTS FOR HOLDING.] The Department of Corrections 
  1.11  shall give a one-year notice, as required under section 244.05, 
  1.12  subdivision 7, to counties prior to release of a level 3 sex 
  1.13  offender.  If the one-year notice is not given, the state must 
  1.14  pay for the cost of holding a level 3 sex offender for civil 
  1.15  commitment under this section. 
  1.16     Sec. 2.  [EFFECTIVE DATE.] 
  1.17     Section 1 is effective the day following final enactment 
  1.18  and requires the Department of Corrections to cover costs 
  1.19  related to offenders released by the department on or after July 
  1.20  1, 2003.
