A bill for an act
relating to natural resources; providing for the protection of native fish and
wildlife species and habitat in the Lake Superior watershed; amending Minnesota
Statutes 2004, section 97B.665, subdivision 1, by adding a subdivision;
proposing coding for new law in Minnesota Statutes, chapters 97C; 103G.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 97B.665, subdivision 1, is amended to read:


Subdivision 1.

Agreement by county board, landowner, and commissioner.

(a)
new text begin Except as provided under subdivision 3, new text end when a drainage watercourse is impaired by a
beaver dam, the commissioner shall take action to remove the impairment, if:

(1) the county board unanimously consents;

(2) the landowner approves;

(3) the commissioner agrees; and

(4) the action is financially feasible.

(b) In a county with unanimous consent of the county board of commissioners and
approval of the landowner, the department shall take action agreed to by unanimous
consent of the county board, the commissioner, and the landowner. The action may
include destruction or alteration of beaver dams and removal of beaver. This subdivision
does not apply to state parks, state game refuges, and federal game refuges.

Sec. 2.

Minnesota Statutes 2004, section 97B.665, is amended by adding a subdivision
to read:

a beaver dam from the Lake Superior watershed unless the beaver dam causes a threat
to personal safety or a serious threat to damage property.

Sec. 3.

new text begin [97C.202] SALMONIDS STOCKING PROHIBITED; LAKE SUPERIOR
AND TRIBUTARIES.

new text begin The commissioner shall not stock, nor grant authority to any person to stock,
nonnative salmonids in Lake Superior or its tributaries.

Sec. 4.

new text begin [103G.55] WATERFALL ALTERATION PROHIBITED; LAKE
SUPERIOR TRIBUTARIES.

new text begin Notwithstanding section 103G.545, subdivision 2, a natural waterfall occurring on a
tributary of Lake Superior shall not be altered or removed.
