  1.1                          A bill for an act 
  1.2             relating to agriculture; providing for payments to 
  1.3             ethanol producers at the level required by statute; 
  1.4             appropriating money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [ETHANOL PRODUCER PAYMENTS.] 
  1.7      Notwithstanding Laws 2003, chapter 128, article 3, section 
  1.8   2, subdivision 4, the commissioner of agriculture shall pay 
  1.9   producers of ethanol the amounts required in Minnesota Statutes, 
  1.10  section 41A.09, subdivision 3a, paragraph (a), for eligible 
  1.11  ethanol production in fiscal years 2004 and 2005. 
  1.12     Sec. 2.  [APPROPRIATION.] 
  1.13     $....... in fiscal year 2004, and $....... in fiscal year 
  1.14  2005, are appropriated from the general fund to the commissioner 
  1.15  of agriculture to make the payments required in section 1. 
  1.16     Sec. 3.  [EFFECTIVE DATE.] 
  1.17     Sections 1 and 2 are effective retroactively from July 1, 
  1.18  2003.
