  1.1                          A bill for an act 
  1.2             relating to public assistance; prohibiting public 
  1.3             assistance recipients from cashing public assistance 
  1.4             payments at tribal gaming establishments; imposing 
  1.5             sanctions; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 256. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [256.744] [PROHIBITION ON WITHDRAWING OR 
  1.9   CASHING PUBLIC ASSISTANCE AT TRIBAL GAMING ESTABLISHMENTS.] 
  1.10     Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.11  a tribal gaming establishment is one that is established under a 
  1.12  tribal-state compact, and is limited to tribal gaming 
  1.13  establishments located in the state of Minnesota. 
  1.14     Subd. 2.  [WITHDRAWING PUBLIC ASSISTANCE.] (a) A public 
  1.15  assistance recipient is prohibited from withdrawing public 
  1.16  assistance with an electronic benefit transfer card at a tribal 
  1.17  gaming establishment. 
  1.18     (b) The commissioner of human services shall terminate 
  1.19  access to public assistance at all automated teller machines 
  1.20  located in tribal gaming establishments. 
  1.21     Subd. 3.  [CASHING PUBLIC ASSISTANCE PAYMENTS.] A public 
  1.22  assistance recipient is prohibited from cashing a public 
  1.23  assistance payment at a tribal gaming establishment. 
  1.24     Subd. 4.  [SANCTIONS.] The commissioner shall impose the 
  1.25  sanctions in paragraphs (a) to (c), if a recipient violates this 
  1.26  section. 
  2.1      (a) For the first violation, 50 percent of the grant 
  2.2   provided to the family for the month following the violation 
  2.3   shall be made in the form of protective or vendor payments. 
  2.4      (b) For the second and subsequent violations, the entire 
  2.5   grant provided to the family must be made in the form of 
  2.6   protective or vendor payments for three months following each 
  2.7   violation. 
  2.8      (c) When protective payments are required and a protective 
  2.9   payee cannot reasonably be found, the county agency may reduce 
  2.10  the monthly assistance grant to the family by 15 percent, and 
  2.11  pay the reduced amount to the caretaker.
