A bill for an act
relating to education; requiring school districts to report school safety incidents
involving students and teachers; amending Minnesota Statutes 2014, section
121A.53, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 121A.53, subdivision 2, is amended to read:


Subd. 2.

Report.

new text begin (a) new text end The school board must include state student identification
numbers of affected pupils on all dismissal reports required by the department. The
department must report annually to the commissioner summary data on the number of
dismissals by age, grade, gender, race, and special education status of the affected pupils.
All dismissal reports must be submitted through the department electronic reporting system.

new text begin (b) The school board must report through the department electronic reporting system
those school safety incidents where a student enrolled in the district physically attacks
or otherwise physically harms a teacher, administrator, or other school staff member. In
preparing the report, the teacher, administrator, or other school staff member and the
school board must consider what is developmentally and age appropriate for the student
and whether the student has an individualized education program or 504 plan. The
commissioner must use summary data to prepare and submit a report to the committees of
the legislature with jurisdiction over kindergarten through grade 12 education annually
by February 1 on the number and type of school safety incidents under this paragraph by
school and district.
