A bill for an act
relating to health; prohibiting local enforcement of federal vaccine passports;
creating a civil cause of action; proposing coding for new law in Minnesota Statutes,
chapter 144.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) To ensure the sovereignty of states' rights guaranteed by the Tenth Amendment to
the United States Constitution and to protect the fundamental individual liberties and privacies
of all persons against an abusive federal government, no government entity or its
subdivisions, agents, designees, or assigns shall have the authority to enforce or attempt to
enforce any vaccine passport, pass, or credential in this state, whether by federal act, law,
executive order, administrative order, court order, rule, regulation, statute, or ordinance.

(b) Any government entity or its subdivisions, agents, designees, or assigns who act to
violate the provisions of this section or otherwise deprive any person the right or privilege
to be free from the enforcement of vaccine passports or vaccine passes or vaccine credentials
shall be liable to the injured party in a civil action or other proper proceeding for redress.
In such actions, the court may award the prevailing party, other than the state of Minnesota
or its subdivisions, agents, designees, or assigns, reasonable attorney fees and costs.
Sovereign, official, or qualified immunity shall not be an affirmative defense in such actions.
