  1.1                          A bill for an act
  1.2             relating to housing; establishing a state program to 
  1.3             supplement the federal emergency shelter grant 
  1.4             program; appropriating money; proposing coding for new 
  1.5             law in Minnesota Statutes, chapter 268. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [268.3715] [EMERGENCY SHELTER GRANTS.] 
  1.8      Subdivision 1.  [STATE SUPPLEMENTAL PROGRAM.] A state 
  1.9   emergency shelter grant program is established and shall be 
  1.10  administered by the commissioner of economic security.  The 
  1.11  state emergency shelter grant program is supplemental to the 
  1.12  federal emergency shelter grants program, authorized by title 
  1.13  IV, Stewart B. McKinney Homeless Assistance Act, United States 
  1.14  Code, title 42, section 11371, et seq., as amended, and, except 
  1.15  as otherwise provided in this section, shall be administered as 
  1.16  provided under federal law. 
  1.17     Subd. 2.  [DEFINITION.] For the purposes of this section, 
  1.18  "homeless" means: 
  1.19     (1) an individual or family which lacks a fixed, regular, 
  1.20  and adequate nighttime residence; or 
  1.21     (2) an individual or family which has a primary nighttime 
  1.22  residence that is: 
  1.23     (i) a supervised publicly or privately operated shelter 
  1.24  designed to provide temporary living accommodations (including 
  1.25  welfare hotels, congregate shelters, and transitional housing 
  2.1   for persons with mental illness); 
  2.2      (ii) an institution that provides a temporary residence for 
  2.3   individuals intended to be institutionalized; or 
  2.4      (iii) a public or private place not designed for, or 
  2.5   ordinarily used as, a regular sleeping accommodation for human 
  2.6   beings. 
  2.7      The term does not include any individual imprisoned or 
  2.8   otherwise detailed pursuant to an act of the Congress or a state 
  2.9   law. 
  2.10     Subd. 3.  [CONFLICT OF LAWS.] For the purposes of the state 
  2.11  program, grantees and the commissioner shall comply with the 
  2.12  federal regulations governing the federal emergency shelter 
  2.13  grant program, except that when a state statute or regulation 
  2.14  conflicts with a federal statute or regulation, the state 
  2.15  statute or regulation shall prevail for projects funded by the 
  2.16  state that may operate differently than the federal program. 
  2.17     Subd. 4.  [COORDINATION REQUIRED.] In administering the 
  2.18  state emergency shelter grants program, the commissioner shall 
  2.19  coordinate with the commissioner's transitional housing 
  2.20  programs, under section 268.38, and the housing finance agency's 
  2.21  family homeless prevention and assistance program, under section 
  2.22  462A.204, which make grants for projects that will help reduce 
  2.23  the demand for emergency shelters by preventing homelessness. 
  2.24     Sec. 2.  [APPROPRIATION.] 
  2.25     Subdivision 1.  [ECONOMIC SECURITY.] $....... is 
  2.26  appropriated from the general fund to the commissioner of 
  2.27  economic security for the purposes of section 1.  This 
  2.28  appropriation is available until expended. 
  2.29     Subd. 2.  [ECONOMIC SECURITY.] $....... is appropriated 
  2.30  from the general fund to the commissioner of economic security 
  2.31  for transitional housing operating costs.  This appropriation is 
  2.32  available until expended. 
  2.33     Subd. 3.  [HOUSING FINANCE AGENCY.] $....... is 
  2.34  appropriated from the general fund to the housing development 
  2.35  fund for the purposes of the family homeless prevention and 
  2.36  assistance program under Minnesota Statutes, section 462A.204.  
  3.1   This appropriation is available until expended. 
  3.2      Subd. 4.  [HOUSING FINANCE AGENCY.] $....... is 
  3.3   appropriated from the general fund to the housing development 
  3.4   fund for the purpose of residential lead paint and lead 
  3.5   contaminated soil abatement under Minnesota Statutes, section 
  3.6   462A.05, subdivision 15c, paragraph (b).
