1.1 A bill for an act 1.2 relating to corrections; amending the appropriation to 1.3 build a close-custody correctional facility of at 1.4 least 800 beds; providing that the new facility shall 1.5 be at level four; deleting certain construction bid 1.6 requirements; amending Laws 1996, chapter 463, section 1.7 16, subdivision 3. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Laws 1996, chapter 463, section 16, subdivision 1.10 3, is amended to read: 1.11 Subd. 3. New Facility 89,000,000 1.12 To complete design and to construct, 1.13 furnish, and equip a new close-custody 1.14 correctional facility at level four to 1.15 provide at least 800 beds. 1.16The commissioner of administration1.17shall develop a design alternative to1.18bid and construct one of the six1.19residential pods at the new facility to1.20accommodate two inmates per cell. This1.21would result in a total of 680 single1.22occupancy close-custody cells, and 1361.23medium-custody double occupancy cells.1.24 The commissioner of administration may 1.25 use construction delivery methods as 1.26 may be appropriate to minimize the cost 1.27 of the facility and maximize the 1.28 construction time savings. 1.29 Before final contract documents for 1.30 this project are advertised for 1.31 construction bids, the commissioners of 1.32 administration and corrections shall 1.33 certify to the chairs of the senate 1.34 finance committee, the senate crime 1.35 prevention finance division, the house 1.36 ways and means committee, the house 1.37 judiciary finance committee, and the 1.38 house capital investment committee that 2.1 the program scope of the project has 2.2 not increased since the project budget 2.3 was reviewed in accordance with 2.4 Minnesota Statutes, section 16B.335. 2.5Upon receipt and evaluation of2.6construction bids and before awarding2.7contracts for the construction phase of2.8the project, the commissioner of2.9administration shall provide the bids2.10and evaluation to the chairs of the2.11senate finance committee and the house2.12ways and means committee and the chairs2.13of the policy committees and finance2.14divisions having jurisdiction over2.15criminal justice policy. Within 142.16days after receiving them, the chairs2.17shall advise the commissioner on which2.18design should be constructed.2.19If the chairs advise the 952-bed2.20option, but the legislature does not2.21appropriate by April 15, 1997, any2.22additional money that may be needed to2.23complete the project with that option,2.24the commissioner shall award the bids2.25for the 800-bed single-cell2.26close-custody facility in order to2.27avoid delays that would further2.28escalate the cost of the project.2.29 Upon receipt and evaluation of 2.30 construction bids and before awarding 2.31 contracts for the construction phase of 2.32 the project, the commissioners of 2.33 administration and finance shall inform 2.34 the same committee chairs of the 2.35 project budget necessary to complete 2.36 that portion of the project. Any 2.37 portion of this appropriation that 2.38 exceeds the project budget shall be 2.39 unallotted by the commissioner of 2.40 finance. 2.41 By February 1 of each year, the 2.42 commissioner shall report to the chairs 2.43 of the house judiciary committee and 2.44 senate crime prevention committee on 2.45 efforts to recruit a workforce for the 2.46 correctional facility that is 2.47 proportional to the protected groups in 2.48 the inmate population, the results of 2.49 the efforts, and recommendations for 2.50 achieving the goal of proportional 2.51 representation of protected class 2.52 employees in relation to the inmate 2.53 population.
