  1.1                          A bill for an act 
  1.2             relating to gambling; state lottery; requiring the 
  1.3             director of the state lottery to establish sports pool 
  1.4             games; establishing a human resources account in the 
  1.5             general fund, to which all net proceeds from these 
  1.6             games must be credited; appropriating money for 
  1.7             nutrition, housing, and health care; amending 
  1.8             Minnesota Statutes 2000, sections 145A.14, by adding a 
  1.9             subdivision; 349A.04; 349A.10, subdivision 5; 349A.13; 
  1.10            proposing coding for new law in Minnesota Statutes, 
  1.11            chapters 16A; 256; 268. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  [16A.727] [HUMAN RESOURCES ACCOUNT.] 
  1.14     It is the policy of the state of Minnesota that no person 
  1.15  in the state should be homeless, hungry, or without health 
  1.16  care.  Therefore, a human resources account in the general fund 
  1.17  is created to meet these basic needs of the people of our 
  1.18  state.  The account consists of net proceeds from sports pool 
  1.19  games deposited in it under Minnesota Statutes, section 349A.10, 
  1.20  subdivision 5. 
  1.21     Sec. 2.  Minnesota Statutes 2000, section 145A.14, is 
  1.22  amended by adding a subdivision to read: 
  1.23     Subd. 5.  [GRANTS FOR COMMUNITY HEALTH CLINICS.] (a) The 
  1.24  commissioner of health may make special grants to community 
  1.25  health boards or nonprofit corporations to establish, operate, 
  1.26  or subsidize clinic facilities and services, including mobile 
  1.27  clinics, to provide community health services in areas of the 
  1.28  state where there are inadequate facilities and services to 
  2.1   serve populations with particular health care needs, such as the 
  2.2   homeless population. 
  2.3      (b) Applicants for grants under this subdivision must 
  2.4   submit to the commissioner for approval a plan and budget for 
  2.5   use of the funds in the form and detail required by the 
  2.6   commissioner.  Recipients of funds under this subdivision must 
  2.7   provide the services required by the commissioner.  They must 
  2.8   report to the commissioner at least annually on the use of the 
  2.9   funds.  Recipients of funds under this subdivision must keep 
  2.10  records, including records of expenditure of funds, required by 
  2.11  the commissioner.  The commissioner may audit the records to 
  2.12  determine eligibility for funds under this subdivision. 
  2.13     Sec. 3.  [256.922] [APPROPRIATIONS FROM ACCOUNT.] 
  2.14     The funds in the human resources account created in section 
  2.15  1 are annually appropriated as follows: 
  2.16     (1) one-third to the housing trust fund account in the 
  2.17  housing development fund created under section 462A.201, for use 
  2.18  by the housing finance agency for the purposes given in section 
  2.19  462A.201, subdivisions 2 and 3; 
  2.20     (2) one-third to the commissioner of economic security for 
  2.21  supplemental food grants under section 268.44; and 
  2.22     (3) one-third to the commissioner of health for grants 
  2.23  under section 145A.14, subdivision 5. 
  2.24     Sec. 4.  [268.44] [GRANTS TO FOODSHELVES.] 
  2.25     Subdivision 1.  [GRANTS.] The commissioner may provide 
  2.26  grants to community foodshelves or other nonprofit programs 
  2.27  distributing food or meals without charge to individuals or 
  2.28  families in need. 
  2.29     Subd. 2.  [APPLICATION AND REPORTS.] Applicants for grants 
  2.30  under this section must submit to the commissioner for approval 
  2.31  a plan and budget for use of the funds in the form and detail 
  2.32  required by the commissioner.  Recipients of funds under this 
  2.33  section must provide food or meals as required by the 
  2.34  commissioner.  They must report to the commissioner at least 
  2.35  annually on the use of the funds.  Recipients of funds under 
  2.36  this section must keep records, including records of expenditure 
  3.1   of funds provided by the commissioner.  The commissioner may 
  3.2   audit the records to determine eligibility for funds under this 
  3.3   section. 
  3.4      Subd. 3.  [RULES.] The commissioner shall adopt rules 
  3.5   setting eligibility criteria for recipients and for use of grant 
  3.6   funds. 
  3.7      Sec. 5.  Minnesota Statutes 2000, section 349A.04, is 
  3.8   amended to read: 
  3.9      349A.04 [LOTTERY GAME PROCEDURES.] 
  3.10     Subdivision 1.  [GENERALLY.] The director may adopt game 
  3.11  procedures governing the following elements of the lottery: 
  3.12     (1) lottery games; 
  3.13     (2) ticket prices; 
  3.14     (3) number and size of prizes; 
  3.15     (4) methods of selecting winning tickets; and 
  3.16     (5) frequency and method of drawings. 
  3.17     Subd. 2.  [SPORTS POOL GAMES.] The director shall adopt 
  3.18  game procedures for games based upon the results of sporting 
  3.19  events. 
  3.20     Subd. 3.  [ADMINISTRATIVE PROCEDURES EXEMPTION.] The 
  3.21  adoption of lottery game procedures is not subject to chapter 14.
  3.22     Sec. 6.  Minnesota Statutes 2000, section 349A.10, 
  3.23  subdivision 5, is amended to read: 
  3.24     Subd. 5.  [DEPOSIT OF NET PROCEEDS.] Within 30 days after 
  3.25  the end of each month, the director shall deposit in the state 
  3.26  treasury the net proceeds of the lottery, which is the balance 
  3.27  in the lottery fund after transfers to the lottery prize fund 
  3.28  and credits to the lottery operations account.  Of the net 
  3.29  proceeds other than net proceeds from sports pool games, 40 
  3.30  percent must be credited to the Minnesota environment and 
  3.31  natural resources trust fund, and during any period in which 
  3.32  bonds are issued and outstanding under section 16A.67, the 
  3.33  remainder must be credited to the special revenue fund created 
  3.34  in section 16A.67, subdivision 3, provided that if bonds are not 
  3.35  issued and outstanding under section 16A.67, such remainder must 
  3.36  be credited to the general fund.  Money credited to the special 
  4.1   revenue fund must be transferred to the debt service fund 
  4.2   established in section 16A.67, subdivision 4, at the times and 
  4.3   in the amounts determined by the commissioner of finance to be 
  4.4   necessary to provide for the payment and security of bonds 
  4.5   issued pursuant to section 16A.67.  On or before the tenth day 
  4.6   of each month, any money in the special revenue fund not 
  4.7   required to be transferred to the debt service fund must be 
  4.8   transferred to the general fund. 
  4.9      Sec. 7.  Minnesota Statutes 2000, section 349A.13, is 
  4.10  amended to read: 
  4.11     349A.13 [RESTRICTIONS.] 
  4.12     Nothing in this chapter: 
  4.13     (1) authorizes the director to conduct a lottery game or 
  4.14  contest the winner or winners of which are determined by the 
  4.15  result of a sporting event other than a horse race conducted 
  4.16  under chapter 240; 
  4.17     (2) authorizes the director to install or operate a lottery 
  4.18  device operated by coin or currency which when operated 
  4.19  determines the winner of a game; and or 
  4.20     (3) (2) authorizes the director to sell pull-tabs as 
  4.21  defined under section 349.12, subdivision 32. 
  4.22     Sec. 8.  [EFFECTIVE DATE.] 
  4.23     This act is effective the day following final enactment.
