A bill for an act
relating to alcoholic beverages; authorizing certain refunds of fees paid for
permits authorizing on-sales of alcoholic beverages after 1:00 a.m.; appropriating
money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin REFUND OF PERMIT FEE.

new text begin The commissioner of public safety shall, upon request of a licensee under Minnesota
Statutes, chapter 340A, refund to the licensee a portion of the fee paid by the licensee to
the commissioner for a permit under Minnesota Statutes, section 340A.504, subdivision
7. The refund must equal 1/12 of the annual fee for the permit for each full month
remaining of the 12 months for which the permit was issued. On the day following the
date on which the commissioner issues a refund under this section, the commissioner shall
revoke the permit, and the authority of the permit holder to make sales authorized by
the permit expires.

new text begin Notwithstanding Minnesota Statutes, section 299A.77, paragraph (a), amounts
sufficient to make refunds under section 1 are appropriated to the commissioner from the
alcohol enforcement account in the special revenue fund.

30, 2006.
