  1.1                          A bill for an act
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             article XIV, section 10, and by adding a section; 
  1.4             providing for new motor fuel tax revenues to go to 
  1.5             public transit, highways, or other transportation 
  1.6             purposes as defined by law; prohibiting use of 
  1.7             property tax revenues for transit purposes. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.10     An amendment to the Minnesota Constitution is proposed to 
  1.11  the people.  If the amendment is adopted, article XIV, section 
  1.12  10, will read: 
  1.13     Sec. 10.  The legislature may levy an excise tax on any 
  1.14  means or substance used for propelling vehicles on the public 
  1.15  highways of this state or on the business of selling it.  The 
  1.16  proceeds of the tax: 
  1.17     (1) that are attributable to tax rates that were in effect 
  1.18  on December 31, 1996, shall be paid into the highway user tax 
  1.19  distribution fund; and 
  1.20     (2) not attributable under clause (1), shall be paid into a 
  1.21  fund established by law for transportation purposes.  Money in 
  1.22  this fund shall be appropriated by law solely for highway 
  1.23  purposes, public transit assistance, and other transportation 
  1.24  purposes as defined by law. 
  1.25     and a section will be added to article XIV to read: 
  1.26     Sec. 12.  After December 31, 1997, no political subdivision 
  2.1   may spend revenues raised from the taxation of real property for 
  2.2   the purpose of providing public transit assistance. 
  2.3      Sec. 2.  [SUBMISSION TO VOTERS.] 
  2.4      The constitutional amendment proposed in section 1 must be 
  2.5   submitted to the people at the 1996 general election.  The 
  2.6   question submitted must be: 
  2.7      "Shall the Minnesota Constitution be amended to require the 
  2.8   revenue from motor fuel tax rates in excess of the rates that 
  2.9   were in effect on December 31, 1996, to be deposited in a fund 
  2.10  for highways, public transit, and other transportation purposes 
  2.11  as defined by law, and to prohibit the use of local property tax 
  2.12  revenues for public transit assistance? 
  2.13                                     Yes .......
  2.14                                     No ........"
