  1.1                          A bill for an act 
  1.2             relating to the building code; exempting border cities 
  1.3             from certain portions of the energy code; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 16B. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [16B.731] [STATE ENERGY CODE IN BORDER CITIES.] 
  1.7      Subdivision 1.  [CHOICE OF ENERGY CODE.] The governing body 
  1.8   of a border city, as specified in section 469.168, subdivision 
  1.9   4, paragraph (c), located on the western border of the state, 
  1.10  may provide by ordinance that:  (1) Minnesota Rules, chapter 
  1.11  7670, in effect on April 14, 2000, specifying the energy code 
  1.12  requirements for residential buildings of the state building 
  1.13  code, shall remain the standard governing the construction of 
  1.14  residential buildings within the jurisdiction of the city after 
  1.15  April 14, 2000; and (2) Minnesota Rules, chapters 7672 and 7674, 
  1.16  shall not apply within the jurisdiction of the city. 
  1.17     Subd. 2.  [NOTICE OF ENERGY CODE REQUIREMENTS.] The 
  1.18  commissioner of administration must develop an energy code 
  1.19  notice to be provided to the original buyer of a newly 
  1.20  constructed single-family or two-family home, or multifamily 
  1.21  residential building of three stories or less, in a city 
  1.22  adopting an ordinance under subdivision 1.  The notice must 
  1.23  include a summary of the requirements of the energy code in 
  1.24  effect in other jurisdictions that have adopted the state 
  1.25  building code, but that are not in effect in the city.  The 
  2.1   notice must also provide contact information for the state 
  2.2   agency responsible for enforcing the energy code.  The 
  2.3   commissioner must provide copies of this notice, upon request, 
  2.4   to builders and municipal building officials in cities adopting 
  2.5   an ordinance under subdivision 1. 
  2.6      A builder of a home for which construction begins after 
  2.7   adoption of an ordinance under subdivision 1 must give the 
  2.8   original buyer a copy of the notice developed under this 
  2.9   subdivision.  The builder must give the original buyer the 
  2.10  notice before the buyer enters into a contract for construction 
  2.11  or purchase of the home. 
  2.12     Sec. 2.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective the day following final enactment.
