A bill for an act
relating to transportation; highways; modifying requirements for transfer of
highways between counties and cities with a population of less than 5,000;
amending Minnesota Statutes 2012, section 163.11, subdivisions 5a, 5b.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 163.11, subdivision 5a, is amended to read:


Subd. 5a.

Hearing on reversion to townnew text begin or city with a population of less than
5,000

new text begin (a) new text end Before adopting a resolution revoking a county highway that would revert in
whole or in part to a townnew text begin or citynew text end , the county board shall fix a date, time and place of
hearing in the townnew text begin or citynew text end where the highway is located to consider the revocation. Not
less than 30 days before the hearing, the county board shall serve notice of the hearing by
certified mail on each member of the townnew text begin or citynew text end board of supervisors. At the hearing the
townnew text begin or citynew text end board and all interested persons shall be entitled to be heard and express their
views on the proposed reversion of the highway to the townnew text begin or citynew text end . After the hearing the
county board may adopt a resolution revoking the highway. The resolution revoking the
highway shall not be effective until the following conditions are met:

(1) the county has completed repairs or improvements on the highway that are
necessary to meet the county standards for a comparable road in the county in which
the townnew text begin or citynew text end is located; and

(2) the county has properly recorded with the county recorder all county interest in
real estate used for the highway.

less than 5,000.

Sec. 2.

Minnesota Statutes 2012, section 163.11, subdivision 5b, is amended to read:


Subd. 5b.

Revoked highway; maintenance.

A county highway that is revoked by a
county board to a townnew text begin or a city with a population of less than 5,000new text end under this section
shall be maintained by the county for a period of two years from the date of revocation.
