  1.1                          A bill for an act 
  1.2             relating to capital improvements; appropriating money 
  1.3             to construct the Battle Point historic site; 
  1.4             authorizing the sale of state bonds; amending Laws 
  1.5             1994, chapter 643, section 19, subdivision 8, as 
  1.6             amended. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [APPROPRIATION.] 
  1.9      $4,500,000 is appropriated from the bond proceeds fund to 
  1.10  the Minnesota historical society to construct, furnish, and 
  1.11  equip the Battle Point historic site. 
  1.12     Sec. 2.  [BOND SALE.] 
  1.13     To provide the money appropriated in section 1 from the 
  1.14  state bond proceeds fund, the commissioner of finance, on 
  1.15  request of the governor, shall sell and issue bonds of the state 
  1.16  in an amount up to $4,500,000 in the manner, upon the terms, and 
  1.17  with the effect prescribed by Minnesota Statutes, sections 
  1.18  16A.631 to 16A.675, and by the Minnesota Constitution, article 
  1.19  XI, sections 4 to 7. 
  1.20     Sec. 3.  Laws 1994, chapter 643, section 19, subdivision 8, 
  1.21  as amended by Laws 1995, First Special Session chapter 2, 
  1.22  article 1, section 45, is amended to read: 
  1.23     Sec. 45.  Laws 1994, chapter 643, section 19, subdivision 
  1.24  8, is amended to read: 
  1.25  Subd. 8.  Battle Point 
  1.26  Historic Site                                           350,000
  2.1   For design of the Battle Point historic 
  2.2   site, preliminary plans for which were 
  2.3   authorized in Laws 1990, chapter 610, 
  2.4   article 1, section 17, and Laws 1992, 
  2.5   chapter 558, section 24, subdivision 5. 
  2.6   Notwithstanding Laws 1990, chapter 610, 
  2.7   article 1, section 17, the planned 
  2.8   educational center will be owned by 
  2.9   independent school district No. 115, 
  2.10  Cass Lake-Bena, and is subject to 
  2.11  Minnesota Statutes, section 16A.695.  
  2.12  The center must be constructed on land 
  2.13  leased to the school district by the 
  2.14  Leech Lake Band of Chippewa Indians 
  2.15  under a ground lease having an initial 
  2.16  term of at least 20 years and a total 
  2.17  term of at least 40 years, including 
  2.18  renewal options.  The school district 
  2.19  must contract with the Leech Lake Band 
  2.20  to operate the center on behalf of the 
  2.21  council school district.  The center 
  2.22  and all classes and programs run by or 
  2.23  through the center must be open to the 
  2.24  public. 
  2.25     Sec. 4.  [EFFECTIVE DATE.] 
  2.26     This act is effective the day following final enactment.
