A bill for an act
relating to health; establishing a statewide cord blood bank; appropriating
money; proposing coding for new law in Minnesota Statutes, chapter 145.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Establishment. new text end

new text begin The commissioner of health shall establish and
maintain a cord blood bank for the storage of umbilical and placental cord blood for
private and public use. The commissioner shall adopt methods for the collection and
storage of cord blood in the state cord blood bank and determine the fee charged to persons
who store their child's cord blood for future private use.

new text begin For the purposes of this section the following terms have
the meanings given:

new text begin (1) "private use" means future autologous use of stored cord blood and donation
of cord blood to a recipient designated by the donor; and

new text begin (2) "public use" means donation of cord blood to persons unrelated or unknown to
the donor and donation of cord blood for research purposes.

new text begin The commissioner of health shall establish
an education campaign for health care providers and expectant parents on the benefits of
public and private storage of umbilical and placental cord blood and cord blood banking
options.

Sec. 2. new text begin STUDY OF PRIVATE CORD BLOOD STORAGE COSTS.

new text begin The commissioner of health, in consultation with the commissioner of human
services and the commissioner of commerce, shall conduct a study of ways to cover the
costs of private cord blood storage and report to the legislature by February 1, 2009. The
report must include recommendations for requiring health plans and medical assistance to
cover the costs of private cord blood storage for persons with known risk factors who are
likely to benefit from a cord blood transplant.

Sec. 3. new text begin APPROPRIATION.

new text begin (a) $....... is appropriated in fiscal year 2009 from the general fund to the
commissioner of health for the establishment of a state cord blood bank and the education
campaign required under Minnesota Statutes, section 145.9285.

commissioner of health to study ways to cover the costs of cord blood storage for private
use.
