1.1 A bill for an act 1.2 relating to education; authorizing the payment of 1.3 additional compensation to school district employees 1.4 based upon performance standards established by the 1.5 school board; establishing a performance-based 1.6 compensation aid; appropriating money; amending 1.7 Minnesota Statutes 1994, section 123.35, by adding a 1.8 subdivision; proposing coding for new law in Minnesota 1.9 Statutes, chapter 124. 1.10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.11 Section 1. Minnesota Statutes 1994, section 123.35, is 1.12 amended by adding a subdivision to read: 1.13 Subd. 6a. [PERFORMANCE-BASED COMPENSATION.] A board is 1.14 authorized to pay additional compensation to any employee based 1.15 on that employee's compliance with performance standards 1.16 established by the board. This compensation may be in addition 1.17 to any other compensation to which the employee would be 1.18 entitled under contract or board policy. The decision as to 1.19 whether to implement a performance-based pay system, the 1.20 adoption of the performance standards, the operation of the 1.21 system, and the determination as to who shall qualify for an 1.22 award shall be made solely at the discretion of the board, shall 1.23 not be a mandatory subject of bargaining under chapter 179A or 1.24 any other law, and shall not be a term or condition of 1.25 employment. A determination by the board as to whether to make 1.26 an award to any individual and the amount of any award shall be 1.27 final and shall not be subject to review by an arbitrator 2.1 through any grievance or other process or by a court through any 2.2 appeal process. 2.3 Sec. 2. [124.255] [PERFORMANCE-BASED COMPENSATION AID.] 2.4 Subdivision 1. [AMOUNT OF AID.] Each school district that 2.5 has established a performance-based compensation system under 2.6 section 1 shall receive performance-based compensation aid in 2.7 the amount of $10 per actual pupil unit. The district shall 2.8 notify the commissioner upon the establishment of a system. 2.9 Subd. 2. [USE OF AID; SEPARATE ACCOUNTS.] The aid may only 2.10 be used to establish and operate a performance-based 2.11 compensation system. A district is not required to expend any 2.12 specific amount of aid in any year. The district shall deposit 2.13 the aid in a separate account within the general fund. 2.14 Sec. 3. [APPROPRIATIONS.] 2.15 Subdivision 1. [DEPARTMENT OF CHILDREN, FAMILIES, AND 2.16 LEARNING.] The sums indicated in this section are appropriated 2.17 from the general fund to the department of children, families, 2.18 and learning for the fiscal years designated. 2.19 Subd. 2.
