A bill for an act
relating to data practices; restricting use of private and nonpublic data to
only those purposes authorized by law; modifying motor vehicle registration
data uses; amending Minnesota Statutes 2014, sections 13.03, by adding a
subdivision; 13.6905, subdivision 3; 168.345, subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2014, section 13.03, is amended by adding a subdivision
to read:

Unless the data subject has otherwise provided
consent, a person who is not the subject of private or nonpublic data but is authorized to
access that data for a purpose expressed by state or federal law:

(1) may only request and use the data for that purpose; and

(2) may not further disseminate the data to another person except for purposes
expressly authorized by law.

The remedies provided in sections 13.08 and 13.09 apply to any person who uses or
disseminates data in violation of this subdivision.

Minnesota Statutes 2014, section 13.6905, subdivision 3, is amended to read:
Various data on motor vehicle registrations
are classified under sections 168.327, subdivision 3, and 168.346.new text begin Use of vehicle
registration data is governed by section 168.345.

Minnesota Statutes 2014, section 168.345, subdivision 2, is amended to read:
The commissioner may not furnish information
about registered owners of passenger automobiles who are lessees under a lease for a term
of 180 days or more to any person except the personnel of law enforcement agencies
and new text begin trade associations performing a member service as permitted in section 604.15,
subdivision 4a, and new text end federal, state, and local governmental units, and, at the commissioner's
discretion, to persons who use the information to notify lessees of automobile recalls.
The commissioner may release information about lessees in the form of summary data,
as defined in section 13.02, to persons who use the information in conducting statistical
analysis and market research.
