A bill for an act
relating to judiciary; including training on mental illnesses in judicial education
program; amending Minnesota Statutes 2020, section 480.30, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 480.30, is amended by adding a subdivision
to read:

new text begin The supreme court's judicial education program must include
ongoing training for judges, judicial officers, and court services personnel on mental illnesses
in children and adults. The program must include education on:

new text begin (1) mental illnesses and symptoms;
new text end

new text begin (2) relating to individuals with mental illnesses and the individuals' families;
new text end

new text begin (3) mental illnesses and the criminal justice system;
new text end

new text begin (4) the mental health system in Minnesota and available community resources in each
judicial district, including opportunities for diversion;
new text end

new text begin (5) psychotropic medications and the medications' side effects;
new text end

new text begin (6) co-occurring mental illnesses and substance use disorders; and
new text end

new text begin (7) any procedures in statute or the Minnesota Rules of Criminal Procedure on
competency restoration and the mental illness or cognitive impairment defense.
