1.1A bill for an act
1.2proposing an amendment to the Minnesota Constitution, article IV, section 12;
1.3adding a provision to allow legislators to call a special session.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.6An amendment to the Minnesota Constitution is proposed to the people. If the
1.7amendment is adopted, article IV, section 12, will read:
1.8Sec. 12. The legislature shall meet at the seat of government in regular session in each
1.9biennium at the times prescribed by law for not exceeding a total of 120 legislative days.
1.10The legislature shall not meet in regular session, nor in any adjournment thereof, after the
1.11first Monday following the third Saturday in May of any year. After meeting at a time
1.12prescribed by law, the legislature may adjourn to another time. "Legislative day" shall be
1.13defined by law. Upon written agreement of the president and majority leader of the senate
1.14and the speaker and majority leader of the house of representatives and upon approval
1.15of this agreement by the committee in each house with jurisdiction over its rules, the
1.16legislature shall convene in special session. Any bill may be considered whose subject
1.17is stated in the agreement that convened the special session. A special session called
1.18by legislators may not exceed seven legislative days. A bill may be passed on the day
1.19prescribed for adjournment of the special session. A special session of the legislature may
1.20be called by the governor on extraordinary occasions.
1.21     Neither house during a session of the legislature shall adjourn for more than three
1.22days (Sundays excepted) nor to any other place than that in which the two houses shall be
1.23assembled without the consent of the other house.

2.1    Sec. 2. SUBMISSION TO VOTERS.
2.2The proposed amendment must be submitted to the people at the 2010 general
2.3election. The question submitted must be:
2.4"Shall the Minnesota Constitution be amended to allow the legislature to meet
2.5in special session for up to seven legislative days upon the agreement of the president
2.6and majority leader of the senate and the speaker and majority leader of the house of
2.7representatives and upon approval of this agreement by the committee in each house
2.8with jurisdiction over its rules?
