  1.1                          A bill for an act
  1.2             relating to health; modifying the definitions of 
  1.3             mental health practitioner and mental health 
  1.4             professional; setting payment rates for pharmacologic 
  1.5             management services; amending Minnesota Statutes 1994, 
  1.6             sections 245.462, subdivisions 17 and 18; 245.4871, 
  1.7             subdivisions 26 and 27; and 256B.0625, by adding a 
  1.8             subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 245.462, 
  1.11  subdivision 17, is amended to read: 
  1.12     Subd. 17.  [MENTAL HEALTH PRACTITIONER.] "Mental health 
  1.13  practitioner" means a person providing services to persons with 
  1.14  mental illness who is qualified in at least one of the following 
  1.15  ways:  
  1.16     (1) holds a bachelor's degree in one of the behavioral 
  1.17  sciences or related fields from an accredited college or 
  1.18  university and has at least 2,000 hours of supervised experience 
  1.19  in the delivery of services to persons with mental illness; 
  1.20     (2) has at least 6,000 hours of supervised experience in 
  1.21  the delivery of services to persons with mental illness; 
  1.22     (3) is a graduate student in one of the behavioral sciences 
  1.23  or related fields and is formally assigned by an accredited 
  1.24  college or university to an agency or facility for clinical 
  1.25  training; or 
  1.26     (4) holds a master's or other graduate degree in one of the 
  1.27  behavioral sciences, or related fields including nursing from an 
  2.1   accredited college or university and has less than 4,000 hours 
  2.2   post-master's experience in the treatment of mental illness. 
  2.3      Sec. 2.  Minnesota Statutes 1994, section 245.462, 
  2.4   subdivision 18, is amended to read: 
  2.5      Subd. 18.  [MENTAL HEALTH PROFESSIONAL.] "Mental health 
  2.6   professional" means a person providing clinical services in the 
  2.7   treatment of mental illness who is qualified in at least one of 
  2.8   the following ways:  
  2.9      (1) in psychiatric nursing:  a registered nurse who is 
  2.10  licensed under sections 148.171 to 148.285, and who is certified 
  2.11  as a clinical specialist in adult psychiatric and mental health 
  2.12  nursing by the American nurses association or who has a master's 
  2.13  degree in nursing or one of the behavioral sciences or related 
  2.14  fields from an accredited college or university or its 
  2.15  equivalent, with at least 4,000 hours of post-master's 
  2.16  supervised experience in the delivery of clinical services in 
  2.17  the treatment of mental illness; 
  2.18     (2) in clinical social work:  a person licensed as an 
  2.19  independent clinical social worker under section 148B.21, 
  2.20  subdivision 6, or a person with a master's degree in social work 
  2.21  from an accredited college or university, with at least 4,000 
  2.22  hours of post-master's supervised experience in the delivery of 
  2.23  clinical services in the treatment of mental illness; 
  2.24     (3) in psychology:  a psychologist licensed under sections 
  2.25  148.88 to 148.98 who has stated to the board of psychology 
  2.26  competencies in the diagnosis and treatment of mental illness; 
  2.27     (4) in psychiatry:  a physician licensed under chapter 147 
  2.28  and certified by the American board of psychiatry and neurology 
  2.29  or eligible for board certification in psychiatry; 
  2.30     (5) in marriage and family therapy:  the mental health 
  2.31  professional must be a marriage and family therapist licensed 
  2.32  under sections 148B.29 to 148B.39 with at least two years of 
  2.33  post-master's supervised experience in the delivery of clinical 
  2.34  services in the treatment of mental illness; or 
  2.35     (6) in allied fields:  a person with a master's degree from 
  2.36  an accredited college or university in one of the behavioral 
  3.1   sciences, or related fields including nursing, with at least 
  3.2   4,000 hours of post-master's supervised experience in the 
  3.3   delivery of clinical services in the treatment of mental illness.
  3.4      Sec. 3.  Minnesota Statutes 1994, section 245.4871, 
  3.5   subdivision 26, is amended to read: 
  3.6      Subd. 26.  [MENTAL HEALTH PRACTITIONER.] "Mental health 
  3.7   practitioner" means a person providing services to children with 
  3.8   emotional disturbances.  A mental health practitioner must have 
  3.9   training and experience in working with children.  A mental 
  3.10  health practitioner must be qualified in at least one of the 
  3.11  following ways:  
  3.12     (1) holds a bachelor's degree in one of the behavioral 
  3.13  sciences or related fields from an accredited college or 
  3.14  university and has at least 2,000 hours of supervised experience 
  3.15  in the delivery of mental health services to children with 
  3.16  emotional disturbances; 
  3.17     (2) has at least 6,000 hours of supervised experience in 
  3.18  the delivery of mental health services to children with 
  3.19  emotional disturbances; 
  3.20     (3) is a graduate student in one of the behavioral sciences 
  3.21  or related fields and is formally assigned by an accredited 
  3.22  college or university to an agency or facility for clinical 
  3.23  training; or 
  3.24     (4) holds a master's or other graduate degree in one of the 
  3.25  behavioral sciences, or related fields including nursing, from 
  3.26  an accredited college or university and has less than 4,000 
  3.27  hours post-master's experience in the treatment of emotional 
  3.28  disturbance. 
  3.29     Sec. 4.  Minnesota Statutes 1994, section 245.4871, 
  3.30  subdivision 27, is amended to read: 
  3.31     Subd. 27.  [MENTAL HEALTH PROFESSIONAL.] "Mental health 
  3.32  professional" means a person providing clinical services in the 
  3.33  diagnosis and treatment of children's emotional disorders.  A 
  3.34  mental health professional must have training and experience in 
  3.35  working with children consistent with the age group to which the 
  3.36  mental health professional is assigned.  A mental health 
  4.1   professional must be qualified in at least one of the following 
  4.2   ways:  
  4.3      (1) in psychiatric nursing, the mental health professional 
  4.4   must be a registered nurse who is licensed under sections 
  4.5   148.171 to 148.285 and who is certified as a clinical specialist 
  4.6   in child and adolescent psychiatric or mental health nursing by 
  4.7   the American nurses association or who has a master's degree in 
  4.8   nursing or one of the behavioral sciences or related fields from 
  4.9   an accredited college or university or its equivalent, with at 
  4.10  least 4,000 hours of post-master's supervised experience in the 
  4.11  delivery of clinical services in the treatment of mental 
  4.12  illness; 
  4.13     (2) in clinical social work, the mental health professional 
  4.14  must be a person licensed as an independent clinical social 
  4.15  worker under section 148B.21, subdivision 6, or a person with a 
  4.16  master's degree in social work from an accredited college or 
  4.17  university, with at least 4,000 hours of post-master's 
  4.18  supervised experience in the delivery of clinical services in 
  4.19  the treatment of mental disorders; 
  4.20     (3) in psychology, the mental health professional must be a 
  4.21  psychologist licensed under sections 148.88 to 148.98 who has 
  4.22  stated to the board of psychology competencies in the diagnosis 
  4.23  and treatment of mental disorders; 
  4.24     (4) in psychiatry, the mental health professional must be a 
  4.25  physician licensed under chapter 147 and certified by the 
  4.26  American board of psychiatry and neurology or eligible for board 
  4.27  certification in psychiatry; 
  4.28     (5) in marriage and family therapy, the mental health 
  4.29  professional must be a marriage and family therapist licensed 
  4.30  under sections 148B.29 to 148B.39 with at least two years of 
  4.31  post-master's supervised experience in the delivery of clinical 
  4.32  services in the treatment of mental disorders or emotional 
  4.33  disturbances; or 
  4.34     (6) in allied fields, the mental health professional must 
  4.35  be a person with a master's degree from an accredited college or 
  4.36  university in one of the behavioral sciences, or related fields 
  5.1   including nursing, with at least 4,000 hours of post-master's 
  5.2   supervised experience in the delivery of clinical services in 
  5.3   the treatment of emotional disturbances. 
  5.4      Sec. 5.  Minnesota Statutes 1994, section 256B.0625, is 
  5.5   amended by adding a subdivision to read: 
  5.6      Subd. 41.  [PAYMENTS FOR PHARMACOLOGIC MANAGEMENT 
  5.7   SERVICES.] Payments for pharmacologic management services 
  5.8   covered under the medical assistance program that are provided 
  5.9   by an advanced practice nurse shall be 80 percent of the rate 
  5.10  paid to physicians.
