  1.2             relating to highways; requiring the commissioner of 
  1.3             transportation to inform and cooperate with certified 
  1.4             local governments and historic preservation 
  1.5             commissions in the conduct of cultural resource 
  1.6             surveys related to trunk highway projects; proposing 
  1.7             coding for new law in Minnesota Statutes, chapter 161. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [161.178] [CULTURAL RESOURCE SURVEYS.] 
  1.10     Subdivision 1.  [DEFINITION.] For purposes of this section: 
  1.11     (1) "cultural resource survey" is an archaeological or 
  1.12  other survey of cultural or historic resources undertaken by the 
  1.13  commissioner as part of the environmental evaluation process for 
  1.14  an existing or proposed trunk highway project; and 
  1.15     (2) "certified local government" means a local unit of 
  1.16  government certified to carry out historic preservation 
  1.17  activities under United States Code, title 16, section 470a. 
  1.18     Subd. 2.  [CONDUCT OF CULTURAL RESOURCE SURVEYS.] (a) The 
  1.19  commissioner shall notify the governing body of the city at 
  1.20  least ten days before undertaking a cultural resource survey in 
  1.21  any statutory or home rule charter city. 
  1.22     (b) In conducting a cultural resource survey in a city that 
  1.23  is a certified local government, the commissioner shall 
  1.24  cooperate to the greatest extent feasible with the city and any 
  1.25  historic preservation commission established in that city.  
  1.26  Before conducting the survey, the commissioner shall inquire of 
  2.1   the city as to what information relevant to the survey has been 
  2.2   compiled and is available.  To the greatest feasible extent, the 
  2.3   commissioner shall share information gathered in the survey with 
  2.4   the city and historic preservation commission. 
  2.5      Subd. 3.  [REPORT.] When a certified local government or 
  2.6   its historic preservation commission participated in or 
  2.7   cooperated with a cultural resource survey, the commissioner 
  2.8   shall provide the certified local government with a copy of the 
  2.9   report resulting from a cultural resource survey at the earliest 
  2.10  feasible date after the completion of the report.
