  1.1                          A bill for an act 
  1.2             relating to crime; expanding the definition of sexual 
  1.3             contact under criminal sexual conduct in the fifth 
  1.4             degree; amending Minnesota Statutes 1995 Supplement, 
  1.5             section 609.3451, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.8   609.3451, subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [CRIME DEFINED.] A person is guilty of 
  1.10  criminal sexual conduct in the fifth degree: 
  1.11     (1) if the person engages in nonconsensual sexual contact; 
  1.12  or 
  1.13     (2) the person engages in masturbation or lewd exhibition 
  1.14  of the genitals in the presence of a minor under the age of 16, 
  1.15  knowing or having reason to know the minor is present.  
  1.16     For purposes of this section, "sexual contact" has the 
  1.17  meaning given in section 609.341, subdivision 11, paragraph (a), 
  1.18  clauses (i) and (iv), but does not include the intentional 
  1.19  touching of the clothing covering the immediate area of the 
  1.20  buttocks.  Sexual contact also includes the intentional removal 
  1.21  or attempted removal of clothing covering the complainant's 
  1.22  intimate parts or undergarments, and the nonconsensual touching 
  1.23  by the complainant of the actor's intimate parts, effected by 
  1.24  the actor, if the action is performed with sexual or aggressive 
  1.25  intent. 
  2.1      Sec. 2.  [EFFECTIVE DATE.] 
  2.2      Section 1 is effective August 1, 1995, and applies to 
  2.3   crimes committed on or after that date.
