  1.1                          A bill for an act 
  1.2             relating to game and fish; allowing multiple 
  1.3             applications for emergency deterrent materials 
  1.4             assistance; amending Minnesota Statutes 1994, section 
  1.5             97A.028, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 97A.028, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [EMERGENCY DETERRENT MATERIALS ASSISTANCE.] (a) 
  1.10  For the purposes of this subdivision, "cooperative damage 
  1.11  management agreement" means an agreement between a landowner and 
  1.12  the commissioner that establishes a program for addressing the 
  1.13  problem of destruction of specialty crops by wild animals on the 
  1.14  landowner's property. 
  1.15     (b) A person may apply to the commissioner for emergency 
  1.16  deterrent materials assistance in controlling destruction of 
  1.17  specialty crops by wild animals.  Subject to the availability of 
  1.18  money appropriated for this purpose, the commissioner shall 
  1.19  provide suitable deterrent materials, up to $3,000 in value per 
  1.20  individual or corporation, when the commissioner determines that:
  1.21     (1) immediate action is necessary to prevent significant 
  1.22  damage from continuing; and 
  1.23     (2) a cooperative damage management agreement cannot be 
  1.24  implemented immediately. 
  1.25     (c) A person may receive emergency deterrent materials 
  2.1   assistance under this subdivision more than once, but the 
  2.2   cumulative total value of deterrent materials provided to a 
  2.3   single person may not exceed $3,000. 
  2.4      (d) As a condition of receiving emergency deterrent 
  2.5   materials assistance under this subdivision, a landowner shall 
  2.6   enter into a cooperative damage management agreement with the 
  2.7   commissioner.  Deterrent materials provided by the commissioner 
  2.8   may include repellents, fencing materials, or other materials 
  2.9   recommended in the agreement to alleviate the damage problem.  
  2.10  If requested by a landowner, any fencing materials provided must 
  2.11  be capable of providing long-term protection of specialty 
  2.12  crops.  A landowner may not receive emergency deterrent 
  2.13  materials assistance under this subdivision more than once.  A 
  2.14  landowner who receives emergency deterrent materials assistance 
  2.15  under this subdivision shall comply with the terms of the 
  2.16  cooperative damage management agreement. 
  2.17     Sec. 2.  [EFFECTIVE DATE.] 
  2.18     Section 1 is effective retroactively to July 1, 1993.
