A bill for an act
relating to child care; making improvements to child
care services; proposing coding for new law in
Minnesota Statutes, chapter 245A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Provider requirements. new text end

new text begin All child care
programs required to be licensed under chapters 119B and 245A
must meet the requirements in chapters 119B and 245A and the
following requirements:

new text begin (1) all child care workers must be certified in first aid
and CPR and remain current in certification;
new text end

new text begin (2) all child care workers must have 32 hours of education
in child development and child care training within the first
six months of employment; and
new text end

new text begin (3) all child care providers must notify parents if a child
care worker or person living in the home who has been
disqualified after a background study receives a variance or set
aside from the commissioner.

new text begin The commissioner of
human services shall ensure that the requirements in clauses (1)
to (3) are met:

new text begin (1) the Department of Human Services shall make unannounced
inspections on five percent of the inspections the department
conducts annually;
new text end

new text begin (2) violations under this subdivision and chapters 119B and
245A shall be posted on the department's Web site; and
new text end

new text begin (3) the department shall institute a violation policy that
regulates licensed day care providers based on severity of the
violation and implement fines according to the severity of
infraction. The following must be included in the violation
policy:

new text begin (i) exceeding staff-to-child ratios;
new text end

new text begin (ii) exceeding license capacity;
new text end

new text begin (iii) failure to comply with background study requirements;
new text end

new text begin (iv) failure to report suspected abuse or neglect of a
child;
new text end

new text begin (v) having hazardous materials or products accessible to
children;
new text end

new text begin (vi) inadequate supervision of children;
new text end

new text begin (vii) maltreatment of a child;
new text end

new text begin (viii) release of a child to an unauthorized person; and

new text begin (ix) violations of behavior guidance.

new text begin The commissioner shall prepare
an annual report by January 15 for the chairs of the house and
senate committees with jurisdiction over child care that
includes the number of inspections completed each year, the
number of inspections that were not completed but were scheduled
to be done, and a list of sanctions, fines, and correction
orders issued each year, as well as the number of license
revocations and providers placed on probation.
