A bill for an act
relating to state government; requiring state funds used for state-funded
projects to use state or American-made goods; proposing coding for new law
in Minnesota Statutes, chapter 16A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Any funds from the state treasury appropriated or otherwise made available for a
state-funded project must require that all of the iron, steel, or manufactured goods used in
the project are produced in the United States.

new text begin (b) The requirement in paragraph (a) shall not apply if the head of a state department
or agency determines that:

new text begin (1) the iron, steel, or manufactured goods needed for the project are not produced in
this state or the United States in sufficiently available quantities and are not of satisfactory
quality; or

new text begin (2) use of iron, steel, or manufactured goods produced in this state or the United
States will increase the cost of the overall project by more than ten percent.

new text begin (c) If the head of a state department or agency determines that it is necessary to
waive the application of paragraph (a) based on one of the criteria in paragraph (b), the
department or agency head must notify the chairs and ranking minority members of the
house of representatives and senate committees with jurisdiction over state appropriations.
