1.1 A bill for an act 1.2 relating to metropolitan government; changing the 1.3 membership of the sports facilities commission; 1.4 amending Minnesota Statutes 1994, section 473.553, 1.5 subdivisions 4, 5, and by adding a subdivision; 1.6 repealing Minnesota Statutes 1994, section 473.553, 1.7 subdivisions 2 and 3. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1994, section 473.553, is 1.10 amended by adding a subdivision to read: 1.11 Subd. 1a. [MEMBERSHIP.] The commission consists of: 1.12 (1) eight members, appointed by the governor from each of 1.13 the following agency districts: 1.14 (i) district A, consisting of council districts 1 and 2; 1.15 (ii) district B, consisting of council districts 3 and 4; 1.16 (iii) district C, consisting of council districts 5 and 6; 1.17 (iv) district D, consisting of council districts 7 and 8; 1.18 (v) district E, consisting of council districts 9 and 10; 1.19 (vi) district F, consisting of council districts 11 and 12; 1.20 (vii) district G, consisting of council districts 13 and 1.21 14; and 1.22 (viii) district H, consisting of council districts 15 and 1.23 16. 1.24 Each member shall be a resident of the district represented. 1.25 Before making an appointment, the governor shall consult with 1.26 each member of the legislature from the district for which the 2.1 member is to be appointed to solicit the legislator's 2.2 recommendation on the appointment; 2.3 (2) two members appointed by the governor from outside of 2.4 the metropolitan area to reflect fairly the various regions and 2.5 interests throughout the state that are affected by the actions 2.6 of the commission. The first members must be appointed by the 2.7 governor as follows: one for a term of 2-1/2 years ending the 2.8 first Monday in January 1999; and one for a term of 4-1/2 years 2.9 ending the first Monday in January 2001. The successors are 2.10 appointed to four-year terms. Before making an appointment, the 2.11 governor shall consult each member of the legislature 2.12 representing the municipality or county from which the member is 2.13 to be appointed to solicit the legislator's recommendation on 2.14 the appointment; and 2.15 (3) a chair appointed by the governor to serve at the 2.16 pleasure of the governor. 2.17 Sec. 2. Minnesota Statutes 1994, section 473.553, 2.18 subdivision 4, is amended to read: 2.19 Subd. 4. [QUALIFICATIONS.] A member shall not during a 2.20 term of office hold the office of metropolitan council member or 2.21 be a member of another metropolitan agency or hold any judicial 2.22 office or office of state government.None of the members2.23appointed by the city council of the city in which the stadium2.24is located shall be an elected public official of that city or2.25of another political subdivision any part of whose territory is2.26shared with that city.Each member shall qualify by taking and 2.27 subscribing the oath of office prescribed by the Minnesota 2.28 Constitution, article V, section 6. The oath, duly certified by 2.29 the official administering it, shall be filed with the chair of 2.30 the metropolitan council. 2.31 Sec. 3. Minnesota Statutes 1994, section 473.553, 2.32 subdivision 5, is amended to read: 2.33 Subd. 5. [TERMS.] The terms ofthreefour of the first 2.34 members appointed under subdivision 1a, clause (1), shall end 2.35 the first Monday in Januaryin the year ending in the numeral2.36"5"1999. The terms of the other four of the first membersand3.1the chairappointed under subdivision 1a, clause (1), shall end 3.2 the first Monday in Januaryin the year ending in the numeral3.3"7"2001. Thereafter, the term of eachmember and the chair3.4 of these members shall be four years. The terms shall continue 3.5 until a successor is appointed and qualified. Members appointed 3.6 under subdivision 1a, clause (1) or (2), may be removed only for 3.7 cause. 3.8 Sec. 4. [REPEALER.] 3.9 Minnesota Statutes 1994, section 473.553, subdivisions 2 3.10 and 3, are repealed. 3.11 Sec. 5. [EFFECTIVE DATE.] 3.12 Sections 1 to 4 are effective July 1, 1996.
