  1.1                          A bill for an act 
  1.2             relating to human services; adjusting the rates for 
  1.3             ICF/MRs with outreach crisis services; amending 
  1.4             Minnesota Statutes, section 256B.501, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 256B.501, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 5d.  [ADJUSTMENT FOR OUTREACH CRISIS SERVICES.] An 
  1.10  ICF/MR with crisis services developed under the authority of 
  1.11  Laws 1992, chapter 513, article 9, section 40, shall have its 
  1.12  operating cost per diem calculated according to paragraphs (a) 
  1.13  and (b). 
  1.14     (a) Effective for rate years beginning on or after October 
  1.15  1, 1994, the maintenance limitation in Minnesota Rules, part 
  1.16  9553.0050, subpart 1, item A, subitem (2), shall be calculated 
  1.17  to reflect capacity as of October 1, 1992.  The maintenance 
  1.18  limit shall be the per diem limitation otherwise in effect 
  1.19  adjusted by the ratio of licensed capacity days as of October 1, 
  1.20  1992, divided by resident days in the reporting year ending 
  1.21  December 31, 1993. 
  1.22     (b) Effective for rate years beginning on or after October 
  1.23  1, 1995, the operating cost per service unit, for purposes of 
  1.24  the cost per service unit limit in section 256B.501, subdivision 
  1.25  5b, paragraph (d), clauses (7) and (8), shall be calculated 
  2.1   after excluding the costs directly identified to the provision 
  2.2   of outreach crisis services and a four-bed crisis unit.
