  1.1                          A bill for an act 
  1.2             relating to the city of Duluth; authorizing the 
  1.3             establishment of special service districts. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [DEFINITIONS.] 
  1.6      For the purpose of this act, the terms defined in this 
  1.7   subdivision have the following meanings: 
  1.8      (1) "City" means the city of Duluth. 
  1.9      (2) "Special services" means all services rendered or 
  1.10  contracted for by the city including, but not limited to: 
  1.11     (i) the construction, repair, maintenance, and operation of 
  1.12  any improvement authorized by Minnesota Statutes, sections 
  1.13  429.021 and 469.126; 
  1.14     (ii) the acquisition of property within a special service 
  1.15  district, including through the use of the power of eminent 
  1.16  domain; 
  1.17     (iii) the sale or lease of property in the special service 
  1.18  district at or below "market rate" for the promotion of 
  1.19  development within the district; 
  1.20     (iv) parking services rendered or contracted for by the 
  1.21  city; 
  1.22     (v) promotional services provided or contracted for by the 
  1.23  city; 
  1.24     (vi) the construction, repair, maintenance, and operation 
  2.1   of traffic control improvements; and 
  2.2      (vii) any other services provided to the public by the city 
  2.3   as authorized by law or charter. 
  2.4      (3) "Special service district" means a defined area within 
  2.5   the city in which special services are rendered and the costs of 
  2.6   special services are paid from revenues collected from service 
  2.7   charges imposed within the area as provided in this section. 
  2.8      Sec. 2.  [ESTABLISHMENT OF DISTRICTS.] 
  2.9      The governing body of the city may adopt ordinances 
  2.10  establishing special service districts.  Minnesota Statutes, 
  2.11  chapter 428A, governs the establishment and operation of special 
  2.12  service districts in the city. 
  2.13     Sec. 3.  [DELEGATION TO ECONOMIC DEVELOPMENT AUTHORITY.] 
  2.14     After the creation of a special service district, the city 
  2.15  council may, by resolution, delegate the operation of the 
  2.16  district to an economic development authority created pursuant 
  2.17  to Minnesota Statutes, sections 469.090 to 469.108. 
  2.18     Sec. 4.  [EFFECTIVE DATE.] 
  2.19     This act is effective the day after the governing body of 
  2.20  the city of Duluth complies with Minnesota Statutes, section 
  2.21  645.021, subdivision 3.
