A bill for an act
relating to insurance; providing for coverage of advance care planning services
by health plans, medical assistance, and MinnesotaCare; amending Minnesota
Statutes 2022, section 256B.0625, by adding a subdivision; proposing coding for
new law in Minnesota Statutes, chapter 62Q.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) For purposes of this section, the following terms have
the meanings given them.

(b) "Advance care planning services" means a discussion between a health professional
and patient to discuss the patient's health care wishes in the event the patient becomes unable
to make decisions about the patient's care. Advance care planning services includes a
discussion of future health care decisions that may need to be made and how the patient can
let others know about health care preferences and decisions, an explanation of health care
directives and similar documents, and completion of a standard health care directive form.

(c) "Health care directive" has the meaning given in section 145C.01, subdivision 5a.

(d) "Health professional" means: (1) a physician, physician assistant, nurse practitioner,
or clinical nurse specialist; or (2) another medical professional or team of medical
professionals working under the direct supervision of a physician.

A health plan that provides coverage to Minnesota residents
must provide coverage for advance care planning services.

This section is effective January 1, 2024, and applies to health
plans offered, sold, issued, or renewed on or after that date.

Minnesota Statutes 2022, section 256B.0625, is amended by adding a subdivision
to read:

(a) Medical assistance covers advance care
planning services.

(b) For purposes of this subdivision, the definitions in section 62Q.547, subdivision 1,
apply.
