  1.1                          A bill for an act
  1.2             relating to education; reinstating funding for summer 
  1.3             school; appropriating money; amending Minnesota 
  1.4             Statutes 1996, section 124.17, by adding a subdivision.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 124.17, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 5a.  [BASIC SKILLS SUMMER SCHOOL PUPIL UNITS.] When a 
  1.9   pupil who has not passed an assessment of basic graduation 
  1.10  standards in reading, writing, or mathematics is enrolled in a 
  1.11  mastery of basic skills summer school program that is not a part 
  1.12  of the regular school term and the student has a total 
  1.13  enrollment time of more than 1,020 hours in a school year, the 
  1.14  pupil may be counted as more than one pupil in average daily 
  1.15  membership for purposes of this subdivision only.  The amount in 
  1.16  excess of one pupil must be determined by the ratio of the 
  1.17  number of hours of instruction provided to that pupil in excess 
  1.18  of 1,020 hours.  For each pupil, only the amount of summer 
  1.19  school enrollment time attributable to basic skills instruction 
  1.20  may be used to calculate the additional hours in the school 
  1.21  year.  Basic skills instruction is defined as in Minnesota's 
  1.22  rules on graduation standards and includes reading, writing, and 
  1.23  mathematics.  Hours that occur after the close of the 
  1.24  instructional year in June are attributable to the following 
  1.25  fiscal year.  A pupil for whom payment is made under this 
  2.1   subdivision may be counted by a district only for the 
  2.2   computation of basic revenue, according to section 124A.22, 
  2.3   subdivision 2. 
  2.4      Sec. 2.  [APPROPRIATION.] 
  2.5      $5,000,000 is appropriated in fiscal year 1999 from the 
  2.6   general fund to the department of children, families, and 
  2.7   learning for summer school aid under section 1. 
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Sections 1 and 2 are effective the day following final 
  2.10  enactment and apply to revenue for summer programs offered 
  2.11  during 1998 and later.
