A bill for an act
relating to appropriations; appropriating money for
grants to test for atrazine in well water.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; REIMBURSEMENT FOR ATRAZINE IN
WELL WATER TESTING.

new text begin (a) $500,000 in fiscal year 2006 is appropriated from the
general fund to the commissioner of agriculture for
reimbursement grants to qualified applicants to facilitate
sampling and laboratory testing for the presence of atrazine and
metabolites of atrazine in domestic water wells in Minnesota.

new text begin (b) The commissioner shall use an Internet Web site and
other appropriate means to make the public aware of the program
and, from time to time, shall report to the public on the status
of remaining funds for grants.

new text begin (c) The commissioner shall prepare and make available to
the public a list of laboratories certified to perform tests for
the detection of atrazine and metabolites of atrazine.
Laboratories on the list must agree to all of the following
conditions:

new text begin (1) Water samples must be tested for atrazine and the three
principal metabolites of atrazine, de-ethyl atrazine,
deisopropyl atrazine and diamino atrazine.

new text begin (2) Results of the water sample tests must be returned to
the person requesting the test.
new text end

new text begin (3) The testing laboratory must report county-by-county
summary results of tests to the commissioner, on a schedule
established by the commissioner, but reported test results must
not reveal the specific source of a tested sample.

new text begin (d) A Minnesota resident qualifies for a grant of the
lesser of $200 or the actual cost of a laboratory test for
atrazine and the metabolites of atrazine if all of the
conditions in clauses (1) to (5) are met:

new text begin (1) The water to be sampled and tested comes from a well
that provides the domestic water supply for the applicant's
residence.

new text begin (2) A laboratory test conducted within the previous 60
months indicated the presence of nitrates in the domestic water
well at a level of five parts per million or higher.

new text begin (3) The test for atrazine and metabolites of atrazine is
performed by a certified laboratory included on the list
maintained by the commissioner.

new text begin (4) The applicant applies for the reimbursement grant
within 90 days after results of the water sample are reported by
the laboratory to the applicant.

new text begin (d) The commissioner must make available to the public
county level summary results of the information on atrazine
levels in tested water wells.
