  1.1                          A bill for an act 
  1.2             relating to the environment; requiring monitoring and 
  1.3             evaluation of public and private wells in areas where 
  1.4             sewage sludge is applied to agricultural land; 
  1.5             authorizing assessment for agency costs; appropriating 
  1.6             money; amending Minnesota Statutes 2002, section 
  1.7             115.03, by adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 115.03, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 10.  [SEWAGE SLUDGE LAND APPLICATION; WELL 
  1.12  MONITORING.] The agency shall monitor and evaluate existing 
  1.13  public and private wells for pollutants in an area where sewage 
  1.14  sludge, as defined in section 115A.03, subdivision 29, from a 
  1.15  permitted wastewater treatment works is applied to agricultural 
  1.16  land.  The agency shall provide the monitoring and evaluation 
  1.17  for at least five years after a land application.  The agency 
  1.18  shall assess the owner of the wastewater treatment works for the 
  1.19  agency's costs of conducting the monitoring and evaluation.  
  1.20  Money collected from assessments under this subdivision is 
  1.21  appropriated to the agency to pay for the costs of monitoring 
  1.22  and evaluation.
