A bill for an act
relating to local government; governing municipal identification cards; proposing
coding for new law in Minnesota Statutes, chapter 415.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) The terms defined in this subdivision apply to this section.

new text begin (b) "Municipal ID" means a photographic identification card in physical or electronic
form created and provided by a municipality to a resident of the municipality that includes
the individual's name, date of birth, and residential address, and any other identifying
information as required or authorized by the municipal ordinance.

new text begin (c) "Municipality" means a home rule charter or statutory city.

new text begin (d) "Resident" means a person who resides within the municipality's corporate boundaries
for a minimum of 30 continuous days immediately prior to application for a municipal ID
and who submits documentation demonstrating identity and residency as required in this
section.

new text begin Ordinance authorized. new text end

new text begin A municipality may adopt an ordinance to provide for
municipal IDs. The ordinance must require an applicant for a municipal ID to submit
documentation of identity and residency using only the documents listed in this section.

new text begin (a) A municipality that has adopted a municipal ID ordinance may
issue a municipal ID to any resident who satisfies the application requirements in the
ordinance, which may include payment of any applicable fee.

new text begin (b) A municipal ID expires four years from the date of issuance. An ordinance may
require surrender of an expired municipal ID or surrender of a municipal ID when the ID
holder is no longer a resident.

new text begin (c) A municipal ID must be produced in a form to prevent unauthorized replication,
alteration, or counterfeiting.

new text begin Requirements for proof of identity and residency. new text end

new text begin (a) An applicant for a
municipal ID must demonstrate identity and residency by submitting one or more of the
documents listed in subdivisions 5 and 6 that, whether solely or combined, provide a
photograph of the applicant and the applicant's full name, date of birth, and residential
address within the municipality's corporate boundaries.

new text begin (b) A submitted document must be an original or a copy certified by the issuing agency.
If the applicant's current legal name is different from the name on an identity document,
the applicant must submit proof of a lawful change of name. A document that is not in
English must be accompanied by a certified translation or an affidavit of translation into
English. A document that is expired may be used to demonstrate identity and residency if
it is accompanied by at least one other document and the requirements of paragraph (a) are
met.

new text begin The following may be used to demonstrate
identity:

new text begin (1) driver's license or identification card issued by any state, the District of Columbia,
or a territory or possession of the United States;
new text end

new text begin (2) tribal driver's license or identification card;
new text end

new text begin (3) consular identification card;
new text end

new text begin (4) United States permanent resident card, commonly known as a "green card";
new text end

new text begin (5) birth certificate issued by any state, the District of Columbia, territory, or possession
of the United States;
new text end

new text begin (6) United States certificate of birth abroad;
new text end

new text begin (7) United States passport or passport card;
new text end

new text begin (8) Minnesota identification card;
new text end

new text begin (9) tribal or Bureau of Indian Affairs affidavit of birth;
new text end

new text begin (10) foreign passport;
new text end

new text begin (11) United States Citizenship and Immigration Services employment authorization
card;
new text end

new text begin (12) United States certificate of naturalization;
new text end

new text begin (13) United States certificate of citizenship;
new text end

new text begin (14) United States military form DD-214;
new text end

new text begin (15) United States military identification card, whether active duty, reserve, or retired;
new text end

new text begin (16) released offender identification from the Minnesota Department of Corrections
with photograph;
new text end

new text begin (17) identification card issued by the national government of a foreign country that
authorizes the use of the card as an alternative to a passport for re-entry into the issuing
country, and that has a photograph of the applicant and the applicant's date of birth;

new text begin (18) United States Social Security Administration card;
new text end

new text begin (19) United States military dependent identification card;
new text end

new text begin (20) United States armed forces driver's license;
new text end

new text begin (21) United States Department of Veterans Affairs card;
new text end

new text begin (22) United States Department of Justice inmate identification card;
new text end

new text begin (23) United States Selective Service card;
new text end

new text begin (24) W-2 form issued by an employer in any state, territory, or possession of the United
States;
new text end

new text begin (25) concealed carry permit issued by any state, territory, or possession of the United
States;
new text end

new text begin (26) medical insurance identification card;
new text end

new text begin (27) professional license issued by any state, the District of Columbia, territory, or
possession of the United States;
new text end

new text begin (28) bank card issued by a bank that does business in any state, territory, or possession
of the United States;
new text end

new text begin (29) credit card issued by a bank that does business in any state, the District of Columbia,
territory, or possession of the United States;
new text end

new text begin (30) school identification issued by a school in any state, the District of Columbia,
territory, or possession of the United States; and
new text end

new text begin (31) marriage license or certificate.

new text begin Subd. 6. new text end

new text begin Proof of residency; documents. new text end

new text begin (a) If the documentation used to demonstrate
identity under subdivision 5 does not also demonstrate residency within the municipality's
corporate boundaries, an applicant must submit one of the following:

new text begin (1) utility bill, including a cable, cell phone, gas, or electric bill, dated within the last 30
days;
new text end

new text begin (2) written verification confirming a minimum of 30 days of residency within the last
30 days issued by a Minnesota licensed homeless shelter;
new text end

new text begin (3) written verification issued by a hospital, health clinic, or county social services
agency confirming a minimum of 30 days of residency within the last 30 days;
new text end

new text begin (4) local property tax statement or mortgage payment receipt dated within the last 30
days;
new text end

new text begin (5) bank account statement dated within the last 30 days;
new text end

new text begin (6) proof of current enrollment in a school located within the municipality's boundaries,
which can be used to establish proof of residency for either the student or a parent of a
student;

new text begin (7) employment pay stub dated within the last 30 days;
new text end

new text begin (8) jury summons or court order issued by a state or federal court dated within the last
30 days;
new text end

new text begin (9) federal or state income tax or refund statement dated within the last 30 days; or
new text end

new text begin (10) insurance bill dated within the last 30 days.

new text begin (b) A document submitted under this subdivision must include both the applicant's name
and a residential address located within the municipality's boundaries.

new text begin Acceptance of municipal ID; preemption. new text end

new text begin A municipal ID is acceptable and
exclusively sufficient proof of identity and residence. The requirements of this section
preempt any administrative rule requirements for proof of identity or residence unless state
statute or federal law requires otherwise.

new text begin A municipal ID issued before August 1,
2019, is valid if it complies with the requirements of this section.

new text begin Violations of ordinance. new text end

new text begin An ordinance may provide for suspension and
revocation of a municipal ID. An ordinance may prohibit counterfeiting, alteration, and
fraudulent use of a municipal ID.
