  1.1                          A bill for an act 
  1.2             relating to animal feedlots; providing state 
  1.3             cost-share money for the expense of certain feedlot 
  1.4             environmental reviews; appropriating money.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [APPROPRIATION; FEEDLOT EIS COST-SHARE.] 
  1.7      (a) $1,000,000 is appropriated from the general fund to the 
  1.8   commissioner of agriculture for the biennium ending June 30, 
  1.9   2003, and is available for grants or interagency transfers for 
  1.10  partial payment on contracts for the preparation of 
  1.11  environmental impact statements on certain animal feedlot 
  1.12  projects.  To be eligible for partial payment under this section:
  1.13     (1) the environmental impact statement must have been 
  1.14  ordered by a district court against the recommendation of the 
  1.15  pollution control agency; or 
  1.16     (2) the pollution control agency must have initially 
  1.17  required the applicant to prepare an environmental assessment 
  1.18  worksheet but subsequently required the preparation of a full 
  1.19  environmental impact statement. 
  1.20     (b) Notwithstanding the provision in Minnesota Rules that 
  1.21  an applicant is required to pay the entire cost of an 
  1.22  environmental impact statement, the commissioner may provide up 
  1.23  to 75 percent of the contract cost and the applicant must pay 
  1.24  the remainder of the contract cost. 
  1.25     (c) If the pollution control agency orders an environmental 
  2.1   impact statement after initially requiring only an environmental 
  2.2   assessment worksheet, as described in paragraph (a), clause (2), 
  2.3   the pollution control agency must develop the statement of need 
  2.4   and reasonableness at no cost to the applicant. 
  2.5      (d) This is a one-time appropriation and remains available 
  2.6   until expended.
